Show abide by international li hereafter Great Britain Decides to Discontinue Partial En-forcement En-forcement of the Declaration Decla-ration of London. LONDON", July 8, 2:19 p. m. In accordance ac-cordance with tin; recent decision of the British government to discontinue the ' partial enforcement of the declaration of Loudon, which lias reference to the conduct of naval warfare, an order in council was published in the London Gazette under which all orders made under the declaration of London since the beginning of the war are withdrawn. The new order declares it to be the intention of Great Britain and her allies al-lies to exercise their belligerent rights at sea in strict accordance with the law of nations. On account of the changed conditions of commerce and the diversity diver-sity of practice, doubts might arise jn - certain matters as to the rules which y f p allies might regard as in conformity I the law of nations, and it is or- l4-r lercd that the following provisions be observed: ''First. The 'hostile destination required re-quired for the condemnation of contraband contra-band articles shall be presumed to exist until the contrary is shown, if the goods arc consigned to or for an enemy authority author-ity or agent of an enemy state, or to or for a person in the territory belonging to or occupied by the enemy, or to or for a person, who during the present hostilities has forwarded contraband goods to an enemy authority or agent of iny enemy state or to a person in territory belonging to or occupied by the enemy, or if the goods arc consigned "to order," or if the ship's papers do not show who is the real consignee of the goods. Continuous Voyage. "Second. The principle of continuous continu-ous vovagc or ultimate destination shall i be applicable both in cases of contraband and blockade. f "Third. A neutral vessel carrying contraband with papers indicating a neutral destination which, notwithstanding notwithstand-ing the destination shown on the papers, proceeds to an enemy port, shall be liable lia-ble to capture and condemnation if she is encountered before the end of her next voyage. ' ' Fourth. A vessel carrying contraband contra-band shall bo liable to capture and condemnation con-demnation if the contraband, reckoned ther by value, weight, volume or freight, forms more than half the cargo." car-go." It is further ordered that nothing in the new regulations shall be deemed to affect the order in council of March 11, 1915, for further restricting the commerce com-merce of the enemy, or any proclamations proclama-tions declaring articles to be contraband of war during the present hostilities; nor shall the new regulations affect the AfV validity of anything done under the or- ijers in council now withdrawal. Special Provision. Anv causo of proceeding commenced in prize court beforo tho making of the new order may, if the court thinks it just, be heard and decided under the orders or-ders withdrawn, so far as they were in force when such cause or proceeding was begun or would have been applicable in such cause or proceeding if tho new order or-der had not been made. The new order is cited as "maritime rights orders in council,. 1916. " |
