with this end In view It has sought from Mme to time to inform In-form Its readers upon as many points as possible In that connection One of the most common causes of complaint made Is that mining com panies advertise In glowing terms > rop ertfeS which may or may not be of con filderablp merit but whIch upon Investi gation are found to be HO undeveloped or involved in litigation and the title therefore so clouded ns to be practically ot little or no present vnlue from tho nUriflier investors point of view in uiany caseo these companies found to hpve no real ownership oC the prop erties they advertIse and In some cases at least Its Impossible fOI them to i secure such ownership It 13 Idle to at tempt to conceal tho fact that there are numerous points of danger which mining Investors whether resident In the mining States und Territories or living abroad must necessarily face and even after every possible precau tion has been taken by the prudent Investor in-vestor he will sometimes fall Into the pit which has been dug for his feet The legal title to public mineral lands docs not pass out of the United States until patent thorcfor haa been duly Issued Is-sued An equitable title only Is acquired ac-quired from the United States at tho time of tho entry and purchase from the United States of a mining claim and even such title docs not paso with the allowance of the entry and payment pay-ment of tho purchao price for the land unless there has been from the inception of the location due compliance compli-ance with the mining IRWB The same ground may be clalmcfi and In many Instances Is claimed under several adverse ad-verse mining locations and a lay examination I ex-amination of the abstract of title of a given mining locatlonwill very often aUlo law and usages governing mining locations can scarce ly l form an Intelligent Judgment ns to who will eventually be found to be enj titled to tho ground Even In cases where there is no question ao to the ownorshlp of tho ground generally there will atlll remain wide possibilities of conflicts and litigation by reason of adverse apex claims departures o veins from side lines and kindred mat ters In cases where tho mining properties are owned by corporations still another an-other class of dlfllcultles arisen Many of the most prominent mining proper ties in Utah passed Into the hands of corporations at a limo when tho values of tho properties were small and for one reason or another It frequently happened that the services of an attorney attor-ney In the formation of the corpora tion were dlnponoed with The result of this often wag that personal liability ensued to the stockholders and directors direct-ors and that the powers of tho corporation cor-poration with reference to holding and making sales of their property and to other corporate functions were very Imperfectly defined and In addition to these still other scrloua IroDrfectlons were disclosed from time to time which the experience of thoao familiar with such matters will readily suggest It not infrequently happens that tho titles to claims which are now worth large sums of money are found to have been clouded because years before when their value was but a song or tho names of the owners not capable of being be-ing ascertained they were assessed for a trifle on the unknown list and the I owners failed to pay tho taxes assessed against them With some of these points borno In mind by unpleasant experience a representative rep-resentative of The Salt Lake Tribune called upon Messrs Whittemoro Blerer Cherrlngton a leading firm of mining mi-ning atotrneys of Utah at their offices In Salt Lake City to obtain desired information In-formation This firm froni Its extensive exten-sive Eastern connections its thorough acquaintance with mining law and practice and Its personal knowledge of past as well as present conditions prevailing pre-vailing in the mining districts of Utah was believed by Tho Tribune representative represen-tative to be unusually well fitted for imparting Information on the various points above enumerated I In the course of the Interview the representative of the firm whose special attention Is given to mining claims and mining litigation stated that In his judgment a very largo proportion of the troubles resulting from Western Investments In-vestments and the consequent disappointment disap-pointment of the Investor and the disrepute dis-repute thereby brought upon the mining mi-ning interests of the Stale arise from a lack of attention on tho part of thi > Investor to themost ordinary pre < Liu tions Too often he takes 110 flyer as he calls It With much ho same spirit that a gambler places his money on a particular card If he wero buying a horse without taking the trouble to make moro than a very superficial in vestigation as to whether or not the parties presenting the proposition have what they claim to have whether they own or control the property or whether such proposition Is one In which an ordinarily Judicious person would Invest In-vest with a reasonable expectation that the venture would prove to be a profitable profit-able one There are numerous attorneys in Utah who either because of their origin ori-gin In tho East or their Eastern connections con-nections can appreciate Eastern con ditions and who are also prepared to give and will give the Investor thoroughly thor-oughly honest and adequate advice It Is of course desirable in seeking Information Infor-mation in the Park City district for instance or for that interests of this State than the I flotation of schemes attractive om their faces but devoid of merit and our brethren of the law aro deserving Of our hearty thanks for what they have done and arc doing In bringing such schemes and their promoters to grief Inquiry among business men of every description confirms these views and The Salt Lake Tribune strongly urges upon prospective Investors even of small amounts that they should scelc to ascertain from somo reliable high class legal authority In the region of the proposed Investment at least a cursory opinion upon the legal phases thereof r We are thoroughly convinced thaesuch a course will In nearly every Instance produce satisfactory results to all JarUes concerned It Is the only course dictated by good Judgment and ordinary
