Show ORDINANCE 02-88 AMENDMENTS TO THE DAVIS COUNTY FLOOD DAMAGE PREVENTION PRE-VENTION ORDINANCE. I WHEREAS, Davis County adopted the Davis County Damage Prevention Ordinance (Number 03-82) on February Febru-ary 25, 1982; and WHEREAS, the Board of County Commissioners of Davis County deem it appropriate to amend certain provisions provi-sions of the Davis County Flood Damage Dam-age Prevention Ordinance; NOW, THEREFORE, be it ordained by the Board of County Commissioners Com-missioners of Davis County, Utah as follows: Section 1. Amendments to Definitions. Defini-tions. a. The following definitions are hereby deleted from Section 3 of the Davis County Flood Damage Prevention Preven-tion Ordinance: 1. Existing Mobile Home Park or Mobile Home Subdivision. 2. Expansion to an Existing Mobile Home Park or Mobile Home Subdivision. Subdivi-sion. 3. Habitable Floor. 4. Mobile Home. 5. New Mobile Home Park or Mobile Home Subdivision. 6. Start of Construction. b. Subsection 3 of the Davis County Flood Damage Prevention Ordinance is hereby amended by adding the following fol-lowing definition: 1 . Lowest Floor. The lowest floor of the lowest enclosed area including basement. An unfinished or flood resistant resis-tant enclosure, usable solely for parking park-ing of vehicles, building access or storage, stor-age, in an area other than a basement area, is not considered a building's lowest floor, provided that such enclosure enclo-sure is not built so as to render the structure in violation of the applicable non-elevation design requirements of this ordinance. 2. Manufactured home. A structure transportable in one or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when connected con-nected to the required utilities. For flood plain management purposes the term "manufactured home" also includes in-cludes park trailers, travel trailers, and other similar vehicles placed on a site for greater than 180 consecutive days. For insurance purposes, the term "manufactured home" does not include in-clude park trailers, travel trailers, and other similar vehicles. 3. Manufactured home, park or subdivision. sub-division. A parcel (or contiguous parcels) par-cels) of land divided into two or more manufactured home lots for rent or sale. 4. Start of construction. Includes substantial improvement, and means the date the building permit was issued, provided the actual start of construction, construc-tion, repair, reconstruction, placement, place-ment, or other improvement was within with-in 180 days of the permit date. The actual start means either the first placement place-ment of permanent construction of a structure on a site, such as the pouring of slab or footings, the installation of piles, the construction of columns, or any work beyond the stage of excavation; excava-tion; or the placement of a manufactured manufac-tured home on a foundation. Permanent Perma-nent construction does not include land preparation, such as clearing, grading and filling; nor does it include the installation in-stallation of streets and-or walkways; nor does it include erxcavation of basement, base-ment, footings, piers, or foundation or the erection of temporary forms; nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not part of the main structure. Section 2. Section 6 of the Davis County Flood Damage Prevention Ordinance is amended to add paragraphs para-graphs 6.5 and 6.6 which shall read as follows: 6.5 Enclosures below lowest floor. Any enclosure area below the base flood elevation are prohibited. pro-hibited. 6.6 Mechanical and utility equipment. (1) Electrical, heating, heat-ing, ventilation, plumbing and air conditioning equipment and other service facilities shall be designed and-or located so as to prevent water from entering or accumulating within the components compo-nents during conditions of flooding. Section 3. Section 7.3 of the Davis County Flood Damage Prevention Preven-tion Ordinance is hereby deleted and the following section is hereby substituted: substi-tuted: 7.3 Manufactured homes. All manufactured homes to be placed or substantially improved within zones Al-30, AH and AE on the community's FIRM be elevated on a permanent foundation founda-tion such that the lowest floor of the manufacture home is at or above the base flood elevation; and be securely anchored to an ' adquately anchored foundation such that the lowest floor of the manufactured home is at or above the base flood elevation, and securely anchored foundation founda-tion system in accordance with this ordinance. This paragraph applies to manufactured homes to be placed or substantially improved im-proved in an expansion to an existing ex-isting manufactrured home park or subdivision. This paragraph does not apply to manufactured homes to be placed or substantially substan-tially improved in an existing manufactured home park or subdivision sub-division except where improvements improve-ments of the streets, utilities and pads equals or exceeds 50 percent per-cent of the value of the streets, utilities and pads before the repair, re-pair, reconstruction or improvements improve-ments has, commenced. Section 4. 4. The term "manufactured "manufac-tured home" is hereby substituted for the term "mobile home" wherever the term "mobile home" is found in the Davis County Flood Prevention Ordinance. Ordi-nance. Section 5. The Davis County Flood Damage Prevention Ordinance (Number (Num-ber 03-82) adopted by the Davis County Commission on February 25, 1982, is reaffirmed except as modified by this Ordinance. Section 6. This Ordinance shall become be-come valid and effective 15 days after its passage or upon the date of its publication publi-cation in a newspaper having general circulation in Davis County, whichever date is later. UNANIMOUSLY PASSED AND APPROVED this 20th day of January, 1988, with Commissioners Harold J. Tippetts, Glen E. Saunders and William Wil-liam L. Peters all voting "aye." DAVIS COUNTY Harold J.
