Show COUNTY ORDINANCE NO. 5-11-61 AN ORDINANCE PROHIBITING THE SELLING AND THE POSSESSION OF BEER IN KEGS WITHIN THE UNINCORPORATED LIMITS OF UINTAH COUNTY, STATE OF UTAH. The Board of County Commissioners of the County of Uintah ordain as follows : SECTION I Definitions: 1. "Beer" means any beverage containing con-taining not less than one half (hi) of one per centum cen-tum of alcohol by weight and obtained by the alcoholic fermentation of an infusion of decoction of any malted grain or similar products and which contains not more than 3.2 per centum of alcohol by weight. Beer may or may not contain hops or other vegetable products. "Beer" includes in-cludes ale, stout and porter. 2. "Person" includes an individual, firm, copartnership, co-partnership, corporation, association or any other or combination, and the plural as well as the singular number, unless the intent to give a more limited meaning is disclosed by the context. 3. "Sell" or "to sell" when used in this ordinance or-dinance in any prohibition prohibi-tion shall be construed to include: (a) to solicit or receive an order for; (b) to keep or expose for sale; (c) to deliver for value; (d) to peddle; (e) to possess with intent to sell; (f) to traffic in; (g) for any consideration, promised or obtained, directly or indirectly or under any pretext or by any means whatsoever, to procure or allow to be procured for any other person; and (h) "sale" when so used shall include in-clude every act of selling as above defined. 4. "Keg" shall be defined defin-ed as a container or the storage and transportation transporta-tion of beer which shall contain in excess of four (4) gallons of beer. SECTION II " ' SALE OR POSSESSION POSSES-SION OF KEGS It shall be unlawful for any person to purchase, consume or possess, either solely or jointly with another, any beer in a keg in the unincorporated unincor-porated areas of Uintah County, State of Utah, except ex-cept that person licensed as manufacturers and distributors and other licensed individuals possessing a valid license to possess keg beer issued by a political subdivision of the State of Utah may possess keg beer for the purpose of transportation through Uintah County or other lawful purposes within Uintah County. SECTION III PENALTY Violations of this act shall be punishable as a misdemeanor by the imposition im-position of a fine in the sum not to exceed $299.00 or by being sentenced to serve not exceeding six (6) months in the county jail, or by both such fine and imprisonment. SECTION IV AMENDMENT OF PRIOR ORDINANCE This ordinance shall amend Ordinance No. 3.6 1978 which Regulates the Sale and Use of Beer and Liquor in Uintah County, Utah, and any provisions in said ordinance which conflict with this ordinance or-dinance shall be considered con-sidered amended so as to conform to this ordinance. or-dinance. All other provisions provi-sions of said ordinance which do not conflict with this ordinance shall remain re-main in full force and effect. ef-fect. This ordinance shall take effect fifteen (15) days after its passage and publication as required by law.
