Show Power of the Governor Questioned Argument as to His Right to Establish Estab-lish Military Rule Being Heard in Denver. DENVER, May 5. Arguments on the writ of habeas corpus issued is-sued on behalf of Charles H. Moyer, president of tho Western Federation of Miners, who has been deprived of his freedom since March 30 by order of Gov. Peabody and is now held as a military prisoner at Tcllurlde. which Is under martial law, were heard by the State Supreme court today. Two full days will be consumed con-sumed In argument, five hours to each side. Thc question at Issue Is whether the Governor of tho State haa authority to establish military rule for the purpose of suppressing what he termed "a Htate of Insurrection and rebellion." due to acts of strikers in his proclamations declaring martial law in Teller, San Miguel Mi-guel and Las Animas counties. Gov. Peubody denies the Jurisdiction of the court ln the caan of Moyer and claims tho right to suspend the writs of courts and to arrest and hold as military prisoners pris-oners any persons whom he deems guilty guil-ty of Inciting "Insurrection." |
