Show BUTTE-SUPERIOR PAYMENT DELAYED Statement appearing in the metropolitan daily papers ou Sunday to the effect that Federal Judge G. M. Bourquin had de-cre?d de-cre?d Saturday at Helena, Mont., that Butte & Superior must pay to the Minerals Min-erals Separation Co., Ltd., between $15,- 000.000 and $20,000,000 damages is entirely entire-ly wrong, says the Boston News Bureau. What Judge Bourcjuin did do was to pass upon the form of the decree after mandate from the United States supreme court finding Butte & Superior liable for infringement of Minerals Separation oil flotation patents, and he ordered a final decree entered conforming to the decision of that court. Judge Bourquin, in his finding last Sat-i Sat-i urday, also ordered an accounting, and i after final entry of the decree issued an order directing Butte & Superior to file a statement of its earnings and profits from oil flotation on or before October 29. 1919. Neither the measure of damages nor the amount to be paid was passed upon by the court, and any statement that Jgutte & Superior had been directed to pay any particular sum to Minerals Separations aside from an item of $7595 for supreme court costs is entirely without with-out foundation. J. Bruce Kramer, counsel for the Butte & Superior, said: "The decree of Judge Bourquin follows strictly the decision of the United States supreme court, the only change In the situation since the rendition of the supreme su-preme court being that a formal decree has now been entered and a time set for the filing of the statement by Butte & Superior. After filing of the statement evidence will be taken and a complete hearing will be had with a view to determining de-termining how much, if anything, Butte & Superior will be compelled to pay Minerals Min-erals Separation." Henry D. Williams, attorney for Minerals Min-erals Separation company, said he estimated esti-mated damages and profits due his company com-pany at between $15,000,000 and $20,000,-000 $20,000,-000 for Infringements running over a period pe-riod of live and one-half years.
