Folio-wing are other excerpts from the testimony taken, -which give the first official and legal version of the killing at the Harris ranch, -which implicates Mrs. Harris, her two sons, Leland and Eugene, Eu-gene, and Edward L. Tackman, their employee, with the murder of Cone and the wounding of Deputy Sheriff Joseph L. Sabey: deputy sheriff, who was standing by a big mail who was standing inside of the fence nearer the house. This big man I have learned is Ed Tackman. He had a gun in his right hand and a pistol in his belt; he quickly changed his gun to the left hand and drew his pistol with his right hand. Fired at While Running. Just then I heard another shot and I then saw Mr. Sabey fall to the ground. I then turned my horse and ran away. Someone commenced shooting at me; at least six bullets were fired at me, for I heard the bullets whizzing or whistling past me, and when I was about 200 or 300 yards away a bullet struck my horse in the back of the thigh, which paralyzed his leg and he stopped. I then got off the horse and ran on foot. Two shots were fired at me while running; one of the bullets hit the ground near me. and then I dropped behind the brush and they stopped shooting. Q. Did you see anyone else at the ranch house or place? If so. state whom and what was said and done. A. Yes-. I saw Mns. Harris, who lives there. She came out of the house as Mr. Cone and myself and Mr. Sabey and my brother, Alburn Nelson, and Walter Stevens all rode up to the gate. The big man spoke to Mr. Sabey and said, "My name is Ed . What are you doing here?" Sabey replied, "We came to pay the damages on the cattle." I think Mrs. Harris then spoke to Mr. (Continued on Page 6, Column 3.) Q Do you know Jesse II. Cone? Sees Big Man With Gun. A Yes. Q Is he alive or dead? -A He is dead. J Q When did he die? - ! A He died on the 22d day of July, 1919. Q Where and how did he die? A He was shot at the Lazy Dav or old Miller ranch in Juab county, Utah. 0 How do you know he was shot? A I saw a man come around the corner of the house at that ranch on that day and raise a gun in his hand and shoot Jesse H. Cone, who was on his horse at the gate, leading into the ranch-house there, and Mr. Cone said, ' Oh, they got me. They got me! M And he slid off his horse and fell on his face on the ground. Mr. Cone then put his J hand against her face and pushed her fl away and said, "Get away. I don't want U to speak to you." She then jumped back nj and said, "Shoot him ! Shoot him! The g dirty cur!" I told him no, but I nearly got shot. He was a resident of Trout Creek, M Juab county, state of Utah, at the time fl of his death. On the 22nd day of July, S 1919, at what is known as the Old Miller t ranch near Trout Creek in said county, g I saw Eugene Harris, who had in his S hand an automatic shotgun, with saJd ffl gun, shoot and kill Jesse H. Cone. Did you say anything to Leland Sj Harris there at that time, or did he say jj anything to you about anything which 1 happened there the day before, that is. on July '2.2, 1919? If so, State what was said. A. I asked Leland Harris where he was when Jesse H. Cone was killed on July 22, 1919, and he answered that he was standing at the northeast corner of the ! porch on the west side of the house.
