Eldrcdgc, Jr., and Salt Lako county is now with the courls. Tho controversy was submitted sub-mitted to the third district court upon an agreed statement of facts by both parties lato Saturday afternoon. Mr. Eldrcdgc 's contention is that under un-der section 13 of the act of June 29. 1908, of the national congress he is entitled en-titled lo retain one-half the naturalization naturaliza-tion fees collected by him as count3' clerk. Tho law is not specific on this point, morcl3r requiring that onu-half the fees shall bo turned over to tho bureau of immigration and naturalization, naturaliza-tion, which 351dredge claims he has done, and sa3'ing that tho othor half shall be rotained b' the county clerk. Whether for this officer's own personal uso or to bo turned over to tho county is not set out. The contention of tho count3' commissioners commis-sioners is that Eldredgo has no interest in tho money; that it belongs to tho count3'. Tho county clerk's salary is fixed by law, the agreed statement of .facts sets out, and this salary is in full 'payment for all services of overy kind and naturo rendered 13' tho count3' clerk, including nuturalizntion work.
