Show Protests shall describe or otherwise identify the property owned of record by the person or persons making the protest. Protests shall be filed with the City Recorder of Cedar City, Utah, on or before 5:00 p.m. on the 10th day of May, 1979. Thereafter at 6:00 p.m. on the 10th day of May, 1979, the City Council will meet in public meeting at the City Chambers to consider all protests so filed and hear all objections relating to the proposed Special Improvement District No. 2. April 112, 19, 26, May 3, and May 10, 1979 NOTICE OF INTENTION P1!8 NOTICE IS HEREBY GIVEN that on the 5th day of April 1979 the Mayor and City Council of Cedar City, Iron County, Utah, adopted a resolution declaring its intention to create a special improvement district to be known as "Cedar City, Utah Special Improvement District No 2" It is the intention in-tention of the City Council to make improvements within said Special Improvement District and to levy special taxes as provided in Chapter 16, Title 10, Utah Code Annotated (1953) as amended, on the real estate lying within said District for the benefit of which such taxes are to be expended in the making of such improvements. DESCRIPTION OF DISTRICT The boundaries of the proposed Special Improvement District shall coincide with the city limits of Cedar City, Utah as of the date of this Notice of Intention. INTENDED IMPROVEMENTS The improvements to be constructed within said Special improvement District No.2 in general include the installation of sewer mains and laterals, water mains and laterals including in-cluding fireplugs and the construction of curb and gutter including in-cluding concrete waterways, covered driveways, street paving, the condemnation or acquisition of any property necessary to make such improvements, and all other miscellaneous work necessary to complete said improvements in a workmanlike manner. Without limiting the above general description of improvements im-provements it is intended that the improvements be constructed con-structed in the designated areas as follows: Sewer l aterals: The excavation for and installation of four inch sewer service laterals: Spruce Street Area Spruce Street from Main Street south to 995 South Street, both sides except where already existent. Fir Street Area Fir Street from Main Street south to the north line of Pinewood Subdivision, both sides except where already existent. 400 North Street Area 400 North Street from 400 West, to 800 West Street, both sides except where already existent. 400 North from 1500 West, west 622 feet, both sides. North Cedar Estates Area 1745 North Street from Main Street, west to Northf ield Road, both sides. ' Northfield Road in front of lots 21 and 22, North Cedar Estates Subdivision. First West Street Area 100 West Street from 400 North Street, north to Coal Creek Road, both sides. ESTIMATED COST OF IMPROVEMENTS The total cost of all improvements in said Special Improvement Im-provement District as estimated by the City Engineer is $355,048, of which the City will pay $64,000 leaving a remainder of approximately $291,048 which shall be paid by a special tax to be levied against the property which may be affected or specifically benefited by such improvements. The property owners' portion of the total estimated cost of the improvements im-provements may be financed during the construction period by the use of interim warrants. The interest on such warrants, if any, will be assess to the property owners. The estimated cost per lineal foot of frontage to be assessed against the properties within said District is as follows: Improvements Estimated Cost Sewer Mains $ 8.05 per front foot Water Mains $ 9.00 per front foot 30" Curb and Gutter $ 5.70 per front foot 36" Curb and Gutter , $ 7. 15 per front foot Sewer Laterals $144.00 for each lateral Street Paving $ .40 per Square Foot Water Laterals $138.00 for each lateral Covered Driveways $ 8.65 per front foot The City will pay for some costs of installing water mains. Paving width varies from street to street within the District ranging from 5.5 feet to 51 feet. Property owners will be assessed based upon the total front feet X "2 the paving width of the street if entire street is paved. Where shoulder paving only is required, property owners will be charged for 2 the paving width of the street less 12.0 feet. ASSESSMENTS AND LEVY OF TAXES It is the intention of the City Council of Cedar City, Utah to levy assessments as provided by the laws of Utah on all parcels par-cels and lots of real property within the District. The purpose of the assessment and levy is to pay those costs of the subject improvements which the City will not assume and pay. The method of assessment shall be apportioned according to lineal front footage of lots and parcels of property within the District. The assessments may be paid by property owners in ten ( 10) annual installments with interest on the unpaid balance at a rate or rates not to exceed nine percent (9 percent) per annum as fixed by the City Council, or the whole or any part of the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. The assessments shall be levied according to the benefits to be derived by each property within the District. Other payment provisions and enforcement remedies shall be in accordance with Chapter 16 of Title 10 of Utah Code Annotated, An-notated, (1953), as amended. A map of the proposed District, copies of plans, profiles and specifications of the proposed improvements and other related information are on file in the office of the City Recorder who will make such information available to all interested persons. TIME FOR FILING PROTESTS Any person who is the owner of record of property to be assessed in the Special Improvement District described in this Notice of Intention shall have the right to file in writing a protest against the creation of Special Improvement District No. 2 or to make any other objections relating thereto. |
