Show Subdivision ordinances to be enforced Iron County. Shumate suggested that an out-of-court settlement might be feasible. "There is no way we're going to stop this problem if we handle it the way that you suggest," said Planning Commissioner Hal Mitchell. Shumate said that increasing numbers of illegal land practices in the county are being brought to the attention of his office. The Iron County Planning Commission Com-mission unanimously passed a motion last week to "begin the fullest enforcement en-forcement of the county subdivision ordinance." They also decided that no subdivision plats would be approved until illegal land sale violations have been resolved. The Commission will proceed with their decisions as soon as they receive a letter of waiver from the Iron County Commission. County Attorney James Shumate favors fining the illegal subdividers whose cases have recently come to the commission's attention. He said that due to the previous laxity in enforcing the law that the present violators of the county subdivision ordinance should be fined the maximum allowed by the law which is $299 for every lot illegally sold, but that criminal prosecution should not be sought. Shumate said that this action . could be viewed as a warning to subdividers in the area and that future violations could then be prosecuted to the full extent of the law. Shumate also suggested that the cases be taken to the justice of the . peace court' rather than the circuit court so that the fines would stay in |
