Show PLUMBING CODE ORDINANCE NO. 80-7 AN ORDINANCE ADOPTING A PLUMBING PLUMB-ING CODE SETTING FORTH MINIMUM PLUMBING STANDARDS: STAN-DARDS: PROVIDING PERMITS, INSPECTIONS, INSPEC-TIONS, FEES, AND RIGHT OF ENTRY: PROVIDING PENALTY FOR THE VIOLATION THEREOF: REPEALING REPEAL-ING ALL ORDINANCES AND PARTS OF ORDINANCES OR-DINANCES IN CONFLICT CON-FLICT THEREWITH, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF VERNAL, UTAH: Section 1 : Title 19 of the revised ordinances of Vernal City, PLUMBING CODE, is hereby enacted as follows : "Title 19" PLUMBING CODE Chapter 19-01. CITY PLUMBING CODE. Chapter 19-01. CITY PLUMBING CODE. Section 19-01-01. Code Adopted; 19-01-02. Administration Ad-ministration and Enforcement; En-forcement; 19-01-03. Permits Per-mits and Inspections; 19-01-04. Fees; 19-01-05. Right of Entry; 19-01-06. Violations; 19-01-07. Penalty-. Section 19-01-01. Code Adopted. The City of Vernal hereby adopts by reference the ICBO Plumbing Code, 1979 Ed. including appendices A, B, C, D, E, F, G, H, K, L, published by the International Interna-tional Conference of Building Officials of Whit-tier, Whit-tier, California, as the Vernal City Plumbing Code, and is made a part of the revised ordinances of the City as though herein fully printed with following amendments, and shall be effective upon filing three copies of the same with 'the City Recorder. Amend Section 1206 (a) to read as follows: ...may drain by -gravity into the main sewer and may be protected from backflow. Amend Section 1504 by -. adding subsection (c) to read as follows: (c) Water Closets located more than 7' from the main building drain vent shall be vented with not less than 2" diameter pipe which may be installed in-stalled as a wet vent. Venting Ven-ting of water closets attached at-tached to a 3" diameter main drain vent not in excess ex-cess of 7' distant need not be back vented. Amend Section 1608 (5c) to read as follows: When street main pressure exceeds ex-ceeds 100 psi, an approved ap-proved ... to reduce the water pressure to 100 pound or lower.. .ADD: if building is equipped with a plastic water distribution system, the system pressure must be reduced to 80 lb. by means of an approved pressure reduction . device. ' Section 19-01-02. Administration Ad-ministration and Enforcement. En-forcement. The building official shall be responsible responsi-ble for the administration and enforcement of the Plumbing Code and shall, among other things, perform per-form all functions of plumbing inspection and shall supervise the construction, con-struction, installation and repair of all plumbing fixtures fix-tures and appliances and apparatus connected with a plumbing system which are installed within the City and shall require that they conform to the provisions of the Plumbing Plumb-ing Code. Plumbing and plumbing fixtures and apparatus ap-paratus heretofore installed in-stalled need not necessarily be made to conform strictly to the provisions of the Plumbing Plumb-ing Code, but the building official shall require the correction of such defects as he deems actually dangerous to life, health, or property. The building official shall follow, as to plumbing work, the procedures pro-cedures relating to enforcement en-forcement and safety as are established by the Uniform Building Code. Section 19-01-03. Permits and Inspection. No new construction, alterations, or additions to existing plumbing shall be installed in the city without first obtaining a permit therefore, except minor repair work of a type commonly accepted as within the capabilities of a householder. Application Applica-tion for a required permit, per-mit, describing such work, shall be made in writing to the building official. of-ficial. No permit shall be issued to any applicant for a permit during the time that said applicant shall fail to correct any defective plumbing installations in-stallations after he has been duly notified to correct cor-rect such defective work by the building official. Section 19-01-04. Fees. An inspection fee for each plumbing permit shall be paid to the building official or City Recorder as follows: $5.00 for the first fifteen plumbing fixture units or fraction thereof as defined defin-ed in the Utah Plumbing Code; plus $3.00 for the next fifteen plumbing fixture fix-ture units or fraction thereof; plus $1.00 for each additional ten plumbing plum-bing fixture units or fraction frac-tion thereof. Single-family Single-family dwellings shall be exempt from said fees. Section 19-01-05. Right of Entry. - (a) Whenever necessary nec-essary to make ' an inspection in-spection to enforce any of the provisions of the Plumbing Code, the building official or his authorized representative represen-tative may enter any building or premises at all reasonable times to inspect in-spect the same or perform per-form any duty imposed upon the building official, provided that (1) if such building or premises be occupied, he shall first present proper credential and demand entry; and (2) if such building or premises be unoccupied, he shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and demand entry. en-try. If such entry is refused, refus-ed, the building official shall have recourse to every remedy provided by law to secure entry. (b) No owner or occupant occu-pant or any other person having charge, care, or control of any building or premises shall fail or neglect, after proper demand de-mand is made as herein provided, to promptly permit entry therein by the building official or his authorized representative represen-tative for the purpose of inspection and examinar . tion pursuant to any provision pro-vision of the Plumbing Code. Section 19-01-06. Violations. No person, firm, or corporation, whether as owner, lessee, sublessee, or occupant, shall construct, alter, repair, or improve any plumbing, plumbing fixtures, fix-tures, appliances or apparatus, ap-paratus, or cause or permit-the same to be done, contrary to or in violation of any of the provisions pro-visions of the Plumbing Code or of any order issued by the building official of-ficial thereunder. Section 19-01-07. Penalty. Any person failing fail-ing to comply with the provisions of the Plumbing Plumb-ing Code shall be guilty of a misdemeanor, and on conviction therefore, shall be punished by a fine in any sum less than $300.00, or by imprisonment for not more than six months, or by both fine and imprisonment. im-prisonment. In all instances in-stances where the viola tion of the Plumbing Code is a continuing violation a separate offense shall be deemed committed on each day during or on which the violation occurs oc-curs or continues. Section 2: If any part of this Ordinance is or shall be declared by a court of competent jurisdiction to be invalid, such invalidity shall not invalidate the remainder of this Ordinance. Or-dinance. Section 3: Ordinance 75-6 "Ordinance Adopting Plumbing Code" of the revised ordinances of Vernal City, as well as any provision of any ordinance or-dinance of the City which conflicts or is inconsistent with any provision of this Ordinance is hereby repealed. Section 4: This Ordinance Or-dinance being necessary for the immediate preservation preser-vation of the peace, health, and safety of the inhabitants of the City shall become effective upon its adoption and publication.
