The application appli-cation for a writ of review filed by Thomas J. Mooney, tnrough his attor-Y attor-Y eys, in the United States supreme court Ul,odi followed two separate refusals of 'Ttate supreme court to grant turn a new trial. Mooney's counsel contended in the Cali-CT Cali-CT fornia courts that his conviction was brought about through malfeasance and rnisfeasance practiced by District Attor-tn Attor-tn ney Charles M. Fickert and the San jjl Francisco police department, but that 'such alleged wrongdoing did not become evident until after his trial. The supreme su-preme court held that it could not go outside the record in the case, and affirmed af-firmed the sentence of death. A writ of error was asked for and refused, and the case was then prepared for the highest tribunal. y Mooney is in San Quentin penitentiary r awaiting execution. |
