Show BECKER CONTINUES BATTLE FOR LIFE Condemned New York Policeman Takes Case to Court of Appeals; Attacks Testimony. NEW YORK, Feb. 27. Arguments to be presented to the court of appeals in the effort to obtain a third trial for Charles Becker, tho former police lieutenant lieu-tenant convicted-for the murder of Herman Her-man .Rosenthal, the gambler, were made public today in a brief filed with tho district attorney by Martin T. Manton of Becker's counsel. Becker's lawyers base their brief for a third trial chiefly on tbe following contentions and allegations: That Becker's guilt was not established es-tablished beyond a reasonable doubt; that his conviction "was brought about by newspaper clamor, the zeal of tbe prosecutor prose-cutor and natural desire .of the actual murderers for self preservation"; preserva-tion"; that the testimony of Jack Bose. one of the chief witnesses for the state, was unqualifiedly false; that Befkr's attorney? were not permitted to introduce at the second sec-ond trial the written confc??ion of Frank Cirof ici. known as ' ' Dsgo Frank," one of the four gunmen electrocuted for the murder. Testimony of several other witness 1 including Charles B. Plitt, Jr.. Becker -former stool pigeon, and Mrs. Lilliar Kosecberg. widow of 1 ' Lefty Louie, ' : one of the gunmen executed for tin murder, is absniled. |
