Show SMELTING CASE IS ENDED BY COURT mi i Action Dismissed by Judge Johnson After Long Litigation Over Alleged Smoke Damages. j Judge Tillman D. Johnson in the federal court yesterday dismissed the case of the Riverside Dairy & Livestock Live-stock company against the American Smelting & Refining company on a , stipulation that the costs in the case would be paid. This is one of the many smelter pmoke cases originating in the Salt Lake valley, where, it was claimed, the smoke from the smelters at Murray damaged the growing crops of farmers and was injurious to live- , stock. ! The case was tried before former Federal Judge John A. Marshall and a judgment for $28,000 was given in favor fa-vor of the plaintiff. The case was appealed to the circuit court of appeals ap-peals of the United States for the Eighth district and that court reversed re-versed the judgment of the local federal fed-eral court and ordered a new trial. The opinion of the appellate court was so broad that the plaintiff refused to prosecute further. The case was dismissed dis-missed with prejudice to the Riverside Dairy fc Livestock company. |
