Show STATE SECRETARY BfflESl KISSED Offsets Testimony Given by Mrs. Irene P. Quinting in Damage Suit. Taking the witness stand in his own defense, David Mattson, secretary of state, denied positively yesterday that he ever endeavored to, kiss Irene F. Quinting. who is suing him before Judge M. L. Ritchie of the Third district court to recover $5000 damages for the alleged purloining of an osculatory caress. At the adjournment of court yesterday yester-day afternoon, tho defendant, together with his counsel, Attorney Frank Evans, Attorney J. W. KcKinn'ey, counsel fo the plaintiff, and the regular court reporter, re-porter, went to the residence of Mrs. Florence M. Kussell, a neighbor of Mrs. Quinting, to take her deposition, Mrs. Russell being too ill to appear in court. It is anticipated that the taking of evidence .in the case will be completed today. As witnesses for the defense. Mrs. Francis Salter and Loretta Siebert, neighbors of Mrs. Lucinda Wagner on Church street, testified as to certain conversations held over the telephone of the Salter residence by Ralph Wag- DeMrs. Salter testified that Ralph Wagner Wag-ner obtained permission to use the telephone, tele-phone, called a certain number and told of an attempt of a certain person to kiss a former employee of a cafe. She testified that he addressed the person per-son to whom he spoke as "judge, and asked if he did not think it a good case. Mrs. Seibert corroborated the testimony of Mrs. Salter. Mrs. Quintinsr was formerly an employee em-ployee at the Kenyon cafe, owned by David Mattson, the defendant. Upon the witness stand, Mr. Mattson admitted meeting Mrs. Quinting on the train from Ogden on the night of January Jan-uary 1 and of accompanying her to her honie, without protest on her part, he testified. Mr. Mattson testified that he carried Mrs. Quinting 's suitcase without objection from her, that when he arrived 'with her at the door of her residence he lingered long enough for her to give him her telephone number that be might call her up if he should know of possible employment for her. |
