Show ORDINANCE AN ORDINANCE AMENDING AMEND-ING DAVIS COUNTY ORDINANCE OR-DINANCE NO. 233, PASSED THE 19th DAY OF JANUARY 1972, RELATING TO THE DAVIS COUNTY FIRE DEPARTMENT AND EFFECTING EF-FECTING CERTAIN CHANGES IN THE STAFF AND ADMINISTRATION THEREOF. Be it hereby ordained by the Board of County Commissioners Commis-sioners of Davis County, State of Utah, as follows: That certain Davis County Ordinance No 233, passed on the 19th day of January, 1972, is hereby amended to read as follows: Section 1. There is hereby created and established a fire department which shall be known as the Davis County Fire Department. Section 2. The officers of the Davis County Fire Department Depart-ment shall be a Chief, Assistant Assis-tant Chiefs, Battalion Chiefs, Captains, Lieutenants, and such other officers as shall be designated and appointed ap-pointed from time to time. The compensation of the officers of-ficers and membe: s of the Fire Department shall be fixed by the Board of Davis County Commissioners. Section 3. (a) The Board of Davis County Commissioners shall appoint the Chief. The Chief may be removed by a majority vote of the Board of Davis County Commissioners. (b) The Assistant Chiefs shall be appointed by the Chief and approved by the Board of Davis County Commissioners. Com-missioners. (c) The Battalion Chiefs shall be appointed by the Chief with first consideration being given to those holding the rank of Captains. Such qualifications as length of service, attitude and previous experience shall be considered con-sidered when selection is made. Appointment shall be approved by the Board of Davis County Commissioners. (d) The Captains shall be appointed by the Chief with first consideration being given to those holding the rank of Lieutenant. Such qualifications as length of service, attitude and previous experience shall be considered con-sidered when selection is made. Appointment shall be approved by the Board of Davis County Commissioners. (e) The Lieutenants shall be appointed by the Chief from the ranks of firemen. First consideration shall be given to length of service, attitude and previous experience. Appointment Ap-pointment shall be approved by the Board of Davis County Commissioners. (f) If deemed necessary by the Chief, those persons being considered for appointment for the office of Captain and Lieutenant may be required to take a written andor oral examination. (g) All officers shall serve for an indefinite period until resignation or removal as provided for herein. Any officer of-ficer may be removed by the Chief upon a showing of good cause, the removal being subject to review by the Board of Davis County Commissioners. Com-missioners. Any member of the Fire Department may be removed by a majority vote of the officers of the Fire Department. Section 4. (a) The fire chief may prescribe and enforce rules and regulations when required in the performance of any of the duties imposed herein upon him or in the exercise of any of the county fire department functions as herein set forth; and he shall prescribe and define the duties du-ties of the other officers of the fire department. (b) The fire chief shall have supervision of the fire department and all apparatus pertaining thereto. In case of fire the fire chief shall have full power and supervision over all members of said fire department, and he shall have full police power and shall have the right to stop or divert any or all traffic on any highway or road and to keep persons at a safe distance from the premises which are on fire and to do all other things necessary for the safety of the public or property. (c) The fire chief shall keep a record of all fires, including the time and place thereof, approximate loss sustained, names of the firemen answering an-swering the call and the time required to extinguish the fire. (d) The fire chief shall inspect in-spect or cause to be inspected by members of the fire department, as often as may be necessary, all buildings and premises within the jurisdiction of the fire department, except private dwellings, for the purpose of ascertaining and causing to . be corrected any conditions liable to cause fire, or any violation of the provisions or intent of any ordinance of the county pertaining to a fire hazard. (e) The fire chief or his as-. sistant or any fireman designated desig-nated by him shall have the right to enter any building or premises within the jurisdiction jurisdic-tion of the fire department, except private dwellings, at all reasonable hours for the purpose of making inspections inspec-tions or investigations relative rela-tive to fires, fire prevention, or safeguarding life and property against fire. (f) The fire chief shall carry out the provisions of any agreement entered into between the county and any city and town pursuant to authority of Utah State Statutes. Sta-tutes. Section 5. (a) The assistant chief shall be in command at all drills and fires in the absence of the chief, with full powers and responsibilities of the chief, and shall have authority upon direction of the chief to command com-mand a squad or a group of men at any drill or fire. (b) In the absence of the chief and assistant chief, the senior captain present shall be in command at all drills and fires and have full powers and responsibilities of the chief. Each captain shall have authority to command a squad upon being authorized by his superior either assigned as-signed to him at drills or actual ac-tual fire combat. Each captain cap-tain shall be responsible for his assigned men including personal problems, drill and fire attendance, clothing, etc. Section 6. Every person - (a) Who shall drive a motor vehicle over a fire hose except upon specific orders from the fire chief or other officer in charge where the hose is in use, or (b) Who shall maliciously turn in or cause to be turned in a false fire alarm, or (c) Who shall at the burning burn-ing of a building disobey the lawful orders of any public officer or fireman, or offer any resistance to or interference in-terference with the lawful efforts ef-forts of any fireman or company com-pany of firemen to extinguish the same, or engages in any disorderly conduct calculated to prevent the fire from being extinguished, or who forbids, prevents or dissuades others from assisting to extinguish the same, Shall be guilty of a Class B Misdemeanor and shall be punishable by a fine of not to exceed $299.00 or imprisonment in the Davis County Jail not to exceed six months, or both. Section 7. It shall be the objective of this organization to serve primarily the residents of South Davis County through the fire department for the protection of life and property and the suppression of fires and to conduct a never ending effort to improve in these services. Section 8. In the opinion ot the Board of County Commissioners Commis-sioners ol Davis County, this Ordinance is necessary for peace, health and safety of Davis County and the inhabitants inhabi-tants thereof. Therefore, this Ordinance shall become effective ef-fective immediately upon its passage and upon a copy being be-ing published in accordance with law, and upon a copy being deposited in the office of the Clerk of Davis County, Utah.
