SUPREME COURT LAYS DOWN IMPORTANT RULE That tho district court has no right to grant extension of tlmo for filing a bill of exceptions on appeal, except where tho application for extension Is made prior to the lapse of the statutory time, Is tho ruling of the supreme court In an opinion rendered yesterday In the case of the Tooele Improvement company against F. Hoffman. Hoffman's appeal Is put aside for this reason. It being shown that he allowed the tlmu for filing fil-ing the bill of exceptions to expire before be-fore applying to the district court for an extension. The improvement company sued to recover re-cover on a contract Involving the construction con-struction of a house. A judgment was rendered for the plaintiff In tho district court and this Is affirmed bv the supreme court.
