RITCHIE REFUSES ABATEMENT ORDER I. X. L. Stores Company Pleads Insufficient Insuffi-cient Notice and Plea Is Held to Bo Good. Holding that tho defendant had not been given sufficient notice that its property, La Melle hotel, was being used for immoral purposes, Judge M. L. Ritchie of the district court yesterday refuscd the city's application for an order against the I. A. L. Stores company com-pany abating the hotel. The action was brought by the eit' under the nuisance and abatement law passed by the last legislature, which provides that suit may bo instituted against owners of buildings used for immoral purposes. The defense argued that the notice served on it concerning tho nature of the La Melle had not been sufficient to justify the abatement abate-ment action and tho court took the same view, dismissing the city's complaint.
