Show HEAR ARGUMENTS ON RESERVOIR SUIT Arguments on the city's demurrer to the Injunction suit brought by the Utah Savings & Trust company to enloln tho city from building tho dama at the head of Bis Cottonwood canyon were made before Judge C. W. Morse In the district court. The hearing was continued until Jude Morse can return from Tooele, whither ho went yesterday afternoon to hold court for several days. The trust company Hiied the city on the ground that the latter was about to proceed pro-ceed with a public work without advertising adver-tising for bids or letting contracts, contending con-tending that under the law public improvements im-provements cannot be conducted without that formality. Local contractors desirous desir-ous of bidding on the work are said to be behind the suit The city Is defending the action on the ground that the law requiring public Improvements Im-provements to be done by contract only applies to Improvements for which a special spe-cial tax la levied. In the caso at Issue $16,000 was appropriated from the city's general fund and no special tax attaches to the work. |
