Show Civil No. 2118 ORDER TO SHOW CAUSE IN THE DISTRICT COURT OF THE FIFTH JUDICIAL DISTRICT IN AND FOR THE COUNTY OF IRON, STATE OF UTAH In the Matter of the General Determination De-termination of the Rights to the Use of Water, both Surface and Underground, in Escalante Valley Val-ley Drainage Area South of the Town of Opal, including but not limited to Pinto Creek, Shoal Creek and Tributaries thereto, and the Beryl and Milford Underground Under-ground Water Areas. Upon reading and filing the Petition of Earl E. Barton, of Loveland, Colorado, alleging that he is the owner of the following water rights situated in the Escalante Es-calante Valley Underground Wa. ter area, to wit: 900 gallons of water per minute min-ute to be used tor incidental stock -watering and domestic purposes pur-poses and for the irrigation of the West half of the Southeast quarter of Section 36, Township 34 South, Range 17 West, Salt Lake Meridian, in Utah from a well 50 feet north and 2000 feet west of the Southeast corner of Section 36, Township 34 South, Range 17 West, Salt Lake Base and Meridian, and which water right has been more particularly set forth in detail in underground water claim No. 17071, filed in the office of the State Engineer of the State of Utah on the 23rd day of November, 1946; and which petition further alleges that through excusable excus-able neglect and Inadvertance water user's claim for Buch water right was not filed by his predecessors prede-cessors in Interest or himself within the time set forth in the summons and notice heretofore published herein and within the time allowed by the office of the State Engineer of the state of Utah; and praying that the within with-in entitled Court make its order confirming the filing of his water wa-ter user's claim at this time, and directing the State Engineer of the State of Utah to duly consider consid-er the same and make proper awards thereunder the samp aa if said water user's claim had been duly presented and filed within the time required by said summons sum-mons and notice and within the time allowed by the office of the State Engineer of the State of Utah; and which petition now on file in the office of the Clerk of the within entitled Court, at Par-owan, Par-owan, Iron County, Utah, is hereby here-by referred to for further details and particulars; and good cause appearing to the satisfaction of the Court therefor: - IT IS HEREBY ORDERED that the water users having water sights within the Escalante Val-' Val-' ley Drainage Area, including the Beryl and Milford Underground Areas, andor any other persons having an interest in the subject matter of the within entitled general adjudication proceedings, show cause, if any they have, in the Courtroom of. the County Courthouse, at Parowan, in Iron County, Utah, on the 10th day of December, 1952, at the hour of ten o'clock A. M. of said day, or as soon thereafter as counsel can be heard, why the Court should not proceed with a hearing hear-ing on said petition and thereafter there-after make the order prayed for in said petition and as more particularly par-ticularly hereinbefore set forth. It is further ordered that notice no-tice of this Order to Show Cause and said petition and the hearing hear-ing thereon shall be given by publication of a copy of this order or-der in the Milford News, a newspaper news-paper having general circulation in Beaver County, Utah, and the Iron County Record, a newspaper newspa-per having general circulation in Iron County, Utah, for three consecutive con-secutive issues next preceding the time fixed herein for showing cause; and it is further ordered that such notice be given by service of a copy of said petition and this order to show cause on the State Engineer of the State of Utah at least 20 days before the time fixed herein for showing cause.
