Show Arson charges dismissed in 7th Circuit Court Charges of aggravated arson and filing a fraudulent insurance claim against the owner of an automobile' repair garage that burned last December have been dismissed in 7th Circuit Court. The Uintah County Attorney's office received notice Friday that the charges against Rocky Hall were dismissed by Judge Whitney B. Hammond, who took . the case under advisement after an April 30 preliminary hearing. In his written decision dated May 10, Judge Hammond stated that he failed to find evidence for the arson charge "connecting the defendant to the crime other than a motive which might have prompted the defendant to commit the crime charged." Because the charge of filing a fraudulent insurance claim was closely connected to the arson charge, Hammond continued, there was no probable cause to believe the alleged fraud occurred. In the April 30 hearing. Deputy Uintah County Attorney Richard Davidson presented expert witnesses that testified arson was the cause of the fire, and associates of Hall, with whose testimony Davidson tried to portray Hall as a person with motive. Davidson admitted however, that he could never prove "who lit the match." He said Monday denial of circumstantial evidence in this instance would not keep him from trying to use such evidence in future preliminary hearings. The April 30 hearing was held for Judge Hammond to decide if enough evidence was present to bind Hall over for trial in 4th District Court. |
