Show Council calls for 24-hour prior notice In regard to an amended complaint against the Ashley Valley Water and Sewer Improvement District filed Oct. 3, by Vernal City, the city council passed a motion for a 24-hour prior notice on legal issues and showed its support of Maeser Water Improvement District. The original suit was initiated against the district last month and was meant as a restraining order against the district soliciting payment from city water users in lieu of paying the city Uie water bills. The suit was liled earlier but was refiled, upon direction of Vernal Mayor Samuel Snyder, to include charges against the district of trying to acquire Vernal water system, and questioning the district's trade of one-third one-third of the lagoon site for one-eighth interest in the water system from Maeser. Apparently the mavor made the addition to the suit without the consent of the council. "And I plan to see it through if it takes a suit against the council," the mayor told the council during Wednesday's Wed-nesday's meeting. Councilman Greg Hawkins made the motion that anytime legal action is being prepared and ready to be filed, that the council be notified 24 hours before hand. The motion passed. Councilman Karl Migliori stressed that "We don't support as a council questioning Maeser in the water business." In other business the council was advised that the Carlon Pipe Company would reimburse the city only half of its (Continued on Page 16) Council calls i , (Continued from Page 1) losses, $24,000, from faulty pipe supplied sup-plied by the company for the Main Street waterline. Several times last fall the pipe exploded after being installed by the city. Shane Luck, city manager, reported that it has been Carlon's tactics to stall on payment for the faulty pipe. Councilman Gene Anfinson moved that the city write a letter to Carlon requesting $36,000 or the city would take other action. The motion passed. The council then went into executive session to discuss the suits with the district. According to Luck, the council moved to accept the district as a water and sewer improvement district if business along East Highway 40 wouldn't be subjected to double taxation taxa-tion by having to pay both the city's and district's bonds. |
