Show . City, asarees flo.-caaree with coynfy In nrsencif Ion syat Because of a recent court ruling in favor of Uintah County, Vernal City has "agreed to agree" to settle the annexation an-nexation suit at 1000 East. This month the court ruled that annexation an-nexation petitions could only be counted one time in the case of one property owner owning several parcels of land. Apparently in annexing east of 1000 East, the city counted each petitioner for each property he owned. According to Clark Allred, county attorney, under the ruling of the court. Vernal City is five petitions short. Vernal City needs about 50 petitions to annex the area east of 1000 East, but under the court ruling the city only has 45.' Acting from the information "that the city is likely to lose the case" from City Attorney Richard Davidson at a council meeting Oct. 15, Councilman Karl Migliori made the motion to settle with the county at 1000 East. Mayor Samuel Snyder refused to entertain the motion saying the council wasn't ready for such action. After some discussion, Migliori moved that the city meet with the county to settle at 1000 East, determine the city's expenses incurred in the contested annexed area, and determine what to do with over $500,000 in sales tax held by the court during the suit. Councilman Jack Seitz and Jack Stagg have met with the county commissioners com-missioners this week and have come to an agreement about the settlement. Details of the settlement have not been approved by the council, but the commissioners appear to be optimistic about the proposal. City Police protection has been cut to 1000 East and other city services in the contested annexation area may be curtailed in 30 days, city officials say. The Commissioners propose to use a protion of the sales tax to build a new nursing home. |
