B pratt felled a libel action for george halverson against william glasmann and the standard publishing company for causing as Is alleged to be published in the morning examiner and the standard papers of wide circulation articles which ha claims damaged his reputation with the legal profession and others to the extent 0 mr glasmann was during tho per peri i lod in which ho is charged with having dictated the attacks on halverson but he la assured by the ars that the reports of the proceedings in the district court and locals appearing in the papers are correct the mayor is BO worried over the filing of action that instead of postponing his pleasure trip to portland he will leave tomorrow night with the standard examiner young ladles for the fair the complaint alleges two separate causes of action and Is as follows for a first cause of action 1 that at the time of the grievances hereinafter mentioned the plaintiff vas and still Is an attorney and counselor at law having been duly admitted to practice in the several courts of record in the state of utah and in iha supreme court of th e united states and for many years prior thereto had practiced and still continues to practice in such capacity and profession at ogden cuy in weber county utah and had always conducted and demeaned himself with honesty and fidelity 2 that at such time said plaintiff was also and still is tb auly elected qualified and acting district attorney in and for the second judicial district of the state of utah 3 that the defendant the standard publishing company was at such times and still Is a corporation organized and existing under the laws of the state of utah and published two certain newspapers at ogden city in said weber county utah known and called the morning examiner and the standard both of which were and are dally newspapers of wide circulation within the state of utah and in other states 4 that the defendant william glasmann during all the times herein mentioned was and still is the editor of said newspapers 6 that on the day 0 june 1803 the said defendant william glasmann composed and caused to bo published and the said defendant the standard publishing company published in each of said newspapers the following words of and concerning the plaintiff and ot and concerning him in his capacity and profession of attorney and counselor at law and district attorney of said second judicial district of the state of utah to wit halverson made the offer district attorney in an atmosphere of bribery he Is looked upon as being quite cheap plays aher part of a bearer of tales george halverson is getting into bad odor there days he had two greek gentlemen arrested tor attempting to bribe him or the munificent sum of 20 why the greeks concluded that 20 might reach the gentleman is not stated now comes toe sniffing virtuous george and says councilman chambers offered to accept a bribe from him in return tor granting a water franchise to the noble and great george halverson this immaculate clean honorable district attorney had a poor greek arrested who offered him 20 to dismiss a law suit but when a city councilman solicits a bribe he does not cause the council mans arrest but carries the story to the new shapers sp apers has georgo been i lying what kind of a prosecuting officer is george that he should arrest a man for asking that a suit be dismissed but allows the bribe solicitor to escape halverton Halve raon attempts bribery councilman chambers was seen this morning and when asked what have you to say about the charge george halverson that you would hava to be eared tor it halverson secured franchise for a water company from the city council you may say tor me said chambers that mr halverson utters a falsehood when he hayg I 1 solicited a bribe from him it Is the other ay he asked me what would take to get him a franchise laughed and said I 1 would like to halt of the vater system when it completed I 1 supposed mr halverson was joking but when he me to give him definite figures I 1 out ot revenge halverson makes a criminal charge in tha news papers for which he should have had the party arrested it true but knowing there was no truth to his charge no arrest will be made we expect in a or two to learn that the clean and virtuous george has been tempted with another bribe the amount to be fully aa large as 30 ants we are addled that george halverson can tell why a certain person he prosecuted or murder escapee without even a days imprisonment it so this paper like to know did george tall to do his duty was he induced to neglect the case or was hta legal knowledge 0 o limited as to havo made him a mouse in the hands 0 the other attorneys since george has been accusing peo plo right and left 0 bribery some ugly stories come to our cars we will have to investigate them C that the said defendants intended and meant by said publication and the readers ot tho same understood that the plaintiff bad been guilty of malfeasance in office the use of his office to harass and oppress innocent persons for private and personal ends and gains also of the offering of bribes for official action and the acceptance of bribes or plaintiffs plaint iffa official action of criminal libel and that the plaintiff waa and is an unfit and incompetent person to exercise the office of district attorney for the second judicial district of the state of utah 7 that said publication was false and defamatory and was maliciously intended by tho defendants and each of them to injure and prejudice this plaintiff in hla reputation and practice aa an attorney and counselor at law nd public prosecuting officer and by means thereof the said plaintiff has been and Is greatly injured and prejudiced in such reputation and practice and held up to ridicule and to the scorn 0 the citizens of the community in which ha resides and of the state generally to his damage in the sum of fifteen thousand dollars for a second cause cf action 6 that on the day of june 1905 the said defendant william glas i mann composes and caused to be pub I 1 lashed and the said defendant the standard publishing company publish ed in each of said two newspapers i the following words of and concerning the plaintiff and of and concerning him in his capacity and profession of i attorney and counselor at law and dis 1 tract attorney for said second judicial district of the state of utah to wit sensation in tha horrocks will case lawyers astounded by the action of one of the attorneys an oath subscribed to Is virtually repudiated ted ethics of the legal profession cast aside the all absorbing point in the horrocks will contest now in the district court is the astounding attitude in which district attorney halverson places himself lawyers of high regard for the ethics of tho profession were amazed when they discovered that Halver wn who sometime ago was a witness to the legality of the will of james E horrocks stepped forward as an associate attorney to prove that what he attested fo sometime ago was only a figment of imagination not one but many 0 the legal lights said that a similar debasement of the profession had seldom been witnessed and one remarked that in some communities a lawyer mho would thus stultify himself would be a practitioner without clients beyond the pale of self respecting attorneys it is a great scheme this new wrinkle of georges and if attorneys practicing in the same office would only adopt it they would bo able to secure many cases which now go lo 10 the thing to do Is this whenever your office partner has an papers or documents to sign which require a witness you act as the witness and it any contest arises go to the conto tel them of your connection with the case and get them to let you banalo it for them that Is the idea and then you have a cinch of course by so doing you discredit yourself as a witness but what of that you get the money and that Is the main thing that is what george halverson did in signing the will george halverson subscribed to the sanity of tha testator in acting as attorney for the con testators george halverson tacitly perjured his oath as a witness george halverson stands discredited but what does george care hes district attorney at the afternoon session the real sensation of the trial came when at macmullan in an impassioned address declared that the position of district attorney halverson in the case was that of a discredited man of a man who bad violated the ethics of the honorable profession to which he belonged and who was a discredit to the high office which he holds during this arraignment halverson slunk down in his chair and his position was anything but a comfortable one as mr macmullan pointed a fang er of scorn at him all eyes were centered on him to nota the changing expression of his countenance halverson Is a disgraced man hal dersons ver sons shame can any person hereafter seriously consider the word of
