Show oo CITY K MUNICIPAL COURT SAYS 0, L Sill Answering the contention, of District Dis-trict Attorney Stuart P. Dobbs, tbat there legally has been no municipal court In Ogden since May 8, Attorney David L. Stine this morning stated: "The new law provides that all cities of the state having a population of more than 7,500 and less than 50,000 inhabitants may croate by ordinance a court to be called 'The Municipal court for the city. It provides further furth-er that tho provisions of the 1907 code, relating to municipal courts, shall apply ap-ply to all cities specified in tho new law, except as otherwise provided. In other words, the new law permits the existing court to exist until the court provided for in the new law is created by ordinance. "The new law provides a means to increase the jurisdiction of, the present pres-ent municipal court in civil cases, but this must be done by ordinance and, until it is done by ordinance, tho present pres-ent court with its present jurisdiction still retains authority and is still the municipal court of Ogden City. It is ridiculous to argue that Judge Barker is only a justice of tho peace as he holds this office only by virtue of his office as municipal Judge." |
