Show IACGIDENTAL DEM VERDICT OF JURY ! Boys Who Ran Over and Killed Woman at Ogden Are Exonerated. Special to The Tribune. OGDEX, July 23 After hearing the testimony of five witne.-isoa a coroner's jury today rendered a vvrdict of accidental acci-dental death in the case of Mrs. Sarah A. Erb, who was killed almost instantly instant-ly when struck by a bicycle last Thursday Thurs-day evening. 1'rancia W. Leahy and Ruer Allison, the boys who were rid-iny rid-iny the bicvclo at tho time of the accident, acci-dent, were the principal witnesses. With Judge George t. Barker, ex-officio coroner, acting as foreman, the jury was composed of k S. Smith, N. A. Tanner and W. J. Critchlow. While it is possible that action may be taken against the boys in the juvenile court, the decision of the coroner's jury virtually closes the case so far as possible pos-sible criminal proceedings ar concerned. The Leahy and Allison boys told virtually vir-tually the" same story that thev related when taken before Chief of Police T. E. Browning by their parents Friday morning. morn-ing. Alarcus Gill, another boy who was riding a bicycle along the sidewalk at the time of "the accident, also testified. Tho other witnesses were J. J. Brumuiitt and Dr. George A. Dickson. According to the testimony of Leahy and Allison, the woman was dressed in material of almost the same color of the sidewalk and, as the spot was shaded by trees, thoy do not remember having seen Mrs. Erb before the bicycle struck her. Both were thrown from the bicycle and stunned by the fall. Tho Allison boy exhibited a black eye as evidence of his injuries, and said he sustained bruises on the legs. Leahy also was bruised. The Gill boy testified that it was ho who called upon Mr. Brummitt for assistance as-sistance and heard him tell his wife to call No. 6, the police headquarters. This information the Gill boy conveyed, to his two companions on tho sidewalk and in their excited condition they decided to escape before the police arrived. Mr. Brummitt testified that his only reason for calling the police headquarters was his belief that a physician and the ambulance am-bulance could be obtained more quickly by that method. Dr. Dickson testi6od that Mrs. Erb was dead when he arrived, death probably prob-ably resulting from a fracture at tho base of the skull. Ho also said she suffered a gash over the left eye. It was his opinion, as stated before the coroner's jury, that her death was instantaneous. in-stantaneous. The jury spent less than fifteen minutes in arriving at its verdict ver-dict of accidental death. |
