Notice is hereby given that at the hour and date, and subject to terms specified below the lands hereinafter herein-after described under Units 1 and 2, known to contain coal in commercial com-mercial quantities, will be offered offer-ed for coal lease by public auction auc-tion in the land office named herein to qualified bidders of the highest cash amount as a bonus for the privilege of leasing pursuant pur-suant to section 2 of the Act of February 25, 1920 (41 Stat. 437), as amended. Sealed bids may be submitted. Such bids will be opened and read at the auction before bidding is commenced by those present. Bids must be made on each unit separately, but no objection will be made to the award of each unit to the same successful. bidder. The envelope used by the bidder must be plainly plain-ly marked that it is not to be opened before the hour and date of the auction, and should show the number of the unit and that the bid is for coal lease. Certified Certi-fied check, cashier's check, or money order made payable to the Bureau of Land Management, or cash, for one-fjfth of the amount of the bid, and a showing by the bidder of his qualifications as specified in 43 CFR 193.11 (a) (2) and (3) must accompany each sealed bid, or be deposited on the date of the sale by any successful oral bidder with the Manager of the Land Office, or other officer conducting the sale. No sealed bid received after the hour and dare- of the sale will be considered. Bidders are warned against committing any act of intimidation, combination of unfair un-fair management to hinder or prevent bidding at the sale in violation of section I860, Title 18, United States Code. The right is reserved to reject any or all bids. After completion of the sale, the amount deposited by the unsuccessful unsuc-cessful bidder with his sealed bid will be refunded. Prior to the issuance is-suance of a lease on the Standard Stand-ard Coal Lease Form 4-696 (March 1951), the successful bidder bid-der must pay the remainder of his bid and' the rental on each acre or fraction thereof, at the rate of 25 cents for the first lease year, and execute and file lease forms and a satisfactory bond of the amount specified herein (43 CFR 193.14). Hour and date of the auction 10:00 A. M., June 30, 1955. Lands to be leased: Unit 1: NE sec. 13, T. 37 S., R. 11 W., S.L.M., Utah, containing 160 acres; Unit 2: Lot 3 (NWUSWtt) sec. 18, T. 37 S., R. 10 W., S.L.M., Utah, containing 40.15 acres. The lands are situated in Iron County, Coun-ty, State of Utah, approximately approximate-ly 12 miles south of Cedar City. Terms for each unit: A minimum mini-mum bid nf $1.C0 n acre or fraction frac-tion thereof; a royalty of 15 cents a ton of 2,000 lbs., mine run; a minimum production equal to a royalty value of $160 a year and $12 a year, respectively, for Units 1 and 2, beginning with the fourth year of the lease; a bond in the sum of $3,000 and $500 respectively. The amount of. the minimum expenditure will be reduced re-duced to the extent that the successful suc-cessful bidder shows that he has already made expenditures for the development of coal deposits on the lands which he owns or leases and that such expenditure will benefit the offered lands, inasmuch in-asmuch as these lands together with the lands which he owns or leases, can be operated as a unit.
