Show SMELTING COMPANY WINS TACOMA SUIT y Experts From Salt Lake Testify at Trial of Test Case Held in State of Washington. Dr. P. J. O'Gara, director of the department de-partment of agricultural investigations for the American Smelting and Refining Re-fining company; F. P. Fleming, chief chemist, and Attorney E. O. Ashton have just returned from Tacoma, Wash., where they 'have "been engaged iu the trial of a smelter smoke case which lasted more than a wek. The suit, which was brought by C. W.J Anderson against the Tacoma Smelting company, was in the nature of attest case, the. plaintiff claiming injury to his truck crops, berries and other fruits due to emanations from the stack of the Tacoma. smelter. The evidence submitted by the smelting smelt-ing company was of a highly technical character and was based upon experimental exper-imental work, which has been curried out during the past four years at the farm and laboratory of the American Smelting and Refining company near Murray, tinder the direction of Dr. P. J. O'Gara and his large staff of investigators. investi-gators. After deliberating less than thirty minutes a jury of twelve men and women wo-men brought in a unanimous verdict for the smelting company, indicating that there was no cause for action and I setting the costs upon the plaintiff.
