Mrs. Jennie Bishop was- not shot, as at first believed, in the revolver battle on West Second South street early yesterday yes-terday morning when Sam Smith, a Bingham minor, wounded Patrolmen Joe Emery and J. G. Smith, after first having attempted to shoot Mrs. Bessie Spencer, with whom he had a quarrel while escorting her home in the company com-pany of some friends from a round of visits to local cafes. Patrolman Pa-trolman Smith, who sustained a flesh wound in the left thigh while he and other officers were closing in on the miner in the rear of 208 West Second South street, was removed to tho L. D. S. hospital yesterday. His wound is not serious. Assailant in Hospital. Sam Smith, the assailant, lies in the prison ward at the emergency hospital, guarded by police, with a bullet wound m the left side, inflicted by one of the officers in the battle preceding the arrest, ar-rest, and another in the jaw, made by one of his own bullets when, realizing that be we captured, he attempted to commit . suicide. Smith was too weak yesterday to make a statement to the police. Mr. and Mrs. C. T. Walker, 362 Sonth West Temple street, called at the emergency emer-gency hospital last night and had a briet conversation with Smith, whom, they said, they knew when he lived in Salmon, Idaho, where his mother, two sisters and a brother reside. Mr. and Mrs. Walker said Smith was merely an acquaintance. Members of the detective force, however, thought they recognized in Mrs. Walker one of Smith's sisters. Smith's father is said to have been a prize fighter. "I hope I'll die before morning," said Smith last night to members of tne hospital force. "If I don't I'll advise my mother tomorrow of what has happened. hap-pened. I'm sorry for what I've done. Drink is responsible for it." Two checks for $100 each drawn by Smith in favor of his mother are held by the police with instructions from the wounded man to forward in the event of his death. Had Planned Suicide. Other statements made by Smith to the nurses indicate that he had contemplated contem-plated suicide and he intimated that there was a written statement to his mother among his effects. Chief of Detectives De-tectives Sharp said no such statement was found among his belongings. David Riley, a chauffeur, believed by the police to have intended to convey Smith out of the city in his automobile, is being held in the city jail as a witness. wit-ness. Mrs. Spencer Mrs. Bishop and a third woman, Mrs. June McGregor, who was taking care of Mrs. Spencer's children chil-dren at the latter 's home at the time of the shooting affray, were released last night. Mrs. McGregor told the police that Smith who had been boarding with Mrs. Spencer for more than a month, came running into the house some time after 3 o'clock in the morning, shouting excitedly: "I have just shot seven policemen, po-licemen, and I'm going out to shoot seven more." Smith Reloads Weapon. He then reloaded his gun, changed his clothes and darted out of the house again, Mrs. Mcuregor saia, togetner with Riley, who had been Bleeping in his room. The police learned yesterday that Riley Ri-ley drove Smith to Warm Springs bathhouse, bath-house, where, according to Riley, he planned taking a bath, but, upon arrival at Warm Springs changed his mind and requested tne chauffeur to take him back home. The police, however, hold the theory that Riley 's purpose was to get Smith awav from the city, but that, arriving at Warm Springs, bo discovered his gasoline gas-oline was giving out, and that his motive mo-tive for returning was to replenish his supply, hoping to get a second start before be-fore the police found his trail. The police having learned that Smith had left the city in a large automobile, Patrolman Crow, wno was assigned to watch the Spencer residence, apnroached Riley while the chauffeur was sitting in his car in front of the house after the return from Warm Springs, and inquired in-quired if he had seen any one leaving tne neighborhood in a limousine. Says Assailant Was Calm. Rilev, the officers say, merely answered an-swered in the negative. Smith was at that moment hiding in the rear of the building. The chauffeur denied any knowledge of a shooting scrape before he took Smith to Warm Springs. He said Smith approached him in a perfectly per-fectly cool manner when he said he wanted to go to Warm Springs for a bath. Jealousy is believed to have been the motive that impelled Smith to attack Mrs. Spencer. According to the accounts ac-counts given the police yesterday of the party's actions before the scrape, it appears ap-pears that Smith became sulky when Mrs. Spencer danced with another man at one of the cafes visited during the night and when they repaired to the Chesapeake restaurant for supper Smith refused to join the rest of the party. Smith and Mrs. Spencer, dropping behind their friends, quarreled, and near the Dooly block Smith suddenly fired a shot at Mrs. Spencer, but missed. When Mrs. Bishop interfered, he struck her on the right temple with his gun. Joseph Slater, watchman of the Dooly block, fired three shots at Smith just before Patrolman Emery arrived on the scene, but the bullets went wide of the mark. Mrs. Spencer, the police learned yesterday, yes-terday, was divorced from her husband more than a year ago, but Spencer nevertheless has been boarding with her practically since the decree was granted.
