Show VERDICT RETURNED 1 111 TRUST ACTION United Fruit Company the Winner in a Suit Involving In-volving Millions. PHILADELPHIA, Jau. 22. A jury in tbe Uuited States court here today returned a verdict for the defendant in the suit of the Bluefields Steamship company against the United Fruit company. com-pany. The suit was entered under the Sherman antitrust law and was known ay the banana trust suit. Millions of dollars were involved in the litigation. The jury had had the case under deliberation delib-eration since Thursday afternoon; Originally the action was for the recovery re-covery of $15,000,000, t the steamship company alleging that its business had been damaged to the extent of $5,000,-000 $5,000,-000 and the law permitting triple damages, dam-ages, but the amount was gTeatly reduced re-duced by a ruling of the judge that the statute of limitations permitted the collection col-lection of damages onlv from 1905 to 1911. It was alleged that the defendant violated vi-olated the Sherman law in acquiring stock control of the Bluefields company and then throttling the concern as a competitor. Judge Thompson instructed the jury that if the two companies mutually formed a monopoly for the purpose of controlling and restraining trade, the steamship company, as a willing party, was not, under the Sherman law, entitled en-titled to redress for damages inflicted by other members of the combine. Tho judge tfapn explained that if the fruit company had wilfully planned and accomplished ac-complished the ruin ' ot the Bluefields corporation, the latter was entitled to a verdict.
