Show WILL TAKE UP DLO : SEIfilTER CASE Long Pending Application for 25,000 Acre-feet Up to State Land Board. Application of the Sevier River Land & Water company for an additional addi-tional 25,000 acre feet of water from the Sevier river to irrigate lands in Millard county will be considered by the state laud board at a special session ses-sion to be held December 20. The company's application has been before the board for several years, but, owing to the contest between the state and the company as to its right to the waters of Scyier river, no final action has er been taken. Several years ago the company took up lands under a Carey act segregation and filed upon water rights in the Sevier Se-vier river sufficient to irrigate the entire en-tire Carey act project, as it thought. 1 Later, fearing that the project would I not succeed, the company released all i but a small portion of its segregation, i but sought to retain all of the water I which it had applied for to irrigate ; thel entire segregation. There was a protest filed with the ; state engineer against the company's being permitted to retain i the iull amount of water rights first filed upon. In the meantime the state had constructed con-structed the Piute reservoir dam, and to protect its rights and to as-sure an ample supply of water or its reservoir sustained the protest made against the Sevier River Land & Water company's excess filings, thus reserving this flow of the river for the state's own use. The Sevier River Land & Water company com-pany contends that the state engineering engineer-ing department was used as an agency ; to beat the company out of water to : which it was entitled. Although tiie action of the engineering department complained of by the company was ! taken some years ago, the present de-1 de-1 partment must defend the former action and justify the state's right to the disputed dis-puted waters of the river. It is the contest of this disputed So.OOO acre feet of flow that will be heard bv the board at its special session on the 20th of this month. It is expected 'that, in addition to representatives of the company, there will be present at the meeting the governor, gov-ernor, the attorney general, the state eirgineer and such" other state officials as may possess information and knowledge knowl-edge concerning tho controversy between be-tween tho l;md and water company and the state. |
