Show STATE HOW AFTER AHOREWWJ1ELS0N Sheriff Emery Refuses to Allow a Deputy to Swear to the Complaint. ACCUSATION IS MADE, BUT IS NOT SWORN TO As Result, Nelson May Not Be Arrested Before Next Wednesday. I Were it not for the fact that Sheriff C. Frank Emery is a close personal friond of Andrew W. Nelson, that young man, who has horctoforo been j charged with robbing tho Utah National Na-tional bank of $100,250, and against j whom a United Stntes indictment bus beon returned and dismissed, would bo again charged at this time with tho samo offense, under a state statute i County Attorney Willard Hanson ' held a long conferenco with United States District Attorney Booth Satur- day, during which Mr. Booth advised j Mr. Hanson as to the details of tbo caso, insofar as ho know thorn, and immediately after Mr. Hanson returned re-turned to 'his own office in tho City and County building and drew a complaint com-plaint against young Nc'son, charging him with the theft of the $100,250. It was tho understanding between Sheriff Emery and County Attorney ! Hanson, it is said by Mr. Hanson, that Deputy Sheriff A'xol Steele would i swear to tho complaint, but, while Mr. Stoelo was in tho county attorney's office, waiting to attach his signature to tho complaint, he was called away by Sheriff Emery. Later, it is said by Mr. Hanson, Sheriff Emery informed in-formed him that he was a closo personal per-sonal friend of Nolson and that he did not want ono of his deputies to swear to the complaint. This means that the matter will go ovor until Wednesday as Mr. Hanson has been called away from the city and will not return until Wednesday morning. morn-ing. An effort was mado Saturday afternoon to secure tho siguatnro of Cashier Badger of tho Utah National to tho complaint, but it was loarncd that Mr. Badger was out of the city, and by tho time of his return Mr. Hanson Han-son will bo away. Mr. Hanson sn'id to The Tribune last night that ho would rctnru to tbo city Wednesday morning and that he wonld havo the complaint sworn to and served during the dav. The action of Sheriff Emery in refusing re-fusing to permit ono of his deputies to swear to the complaint, for tho simple sim-ple reason thnt Emery and the young banker are personal friends, needs no comment, other things considered.
