Show 'Council Rejects Referendum j On Legal Basis A petition for a referendum vote on the City ordinance re cently passed t' grant a 20-yeai franchise to the Southern I ta! Power company was filed with the city recorder Saturday, but was rejected at a special meetinj of the City Council Morula; night on the grounds of legality. The council after studying tin referendum petition in the special spe-cial meeting suggested that the legality of the procedure shouk be determined in court. The referendum petition wa; signed by 430 residents of Ceda City who had been certified a: qualified voters, which is a suf flcient number of signers t force the referendum vote if th proper legal procedures have been followed. Following the meeting Monday night a statement was Issued by the Mayor and city council as follows: "There is a question as to the legality of the petition as prepared pre-pared and submitted by the sponsors and as certified by the County Clerk. "It is the opinion of the City Attorney and City Recorder and concurred in by the Council that as presented it is insufficient in Its legality. The Council feels that a riecisi -n by the Court should determine whether or not the petition as submitted and presented can legally be present-' ed to the people lor action." The only question to bo decided de-cided by a referendum vote is whether or not an ordinance adopted by the City Council granting the franchise to the power company, should be set aside. It does not carry any question of the city entering the municipal power field, or the establishment es-tablishment of any other power generating or distribution plant. |
