Ralelsrh, deceased, j filed a petition in the District court yes terday alleging that TVlllIam Aspor I and Alfred Solomon, as executors of ' the will of the deceased, have failed 'I and neglected to perform the duties of ' fholr trust faithfully, and asking: for ' Uielr removal by the court. The peti tion sets out thut Alonao II. Italclgh died In this city on May 13, 1901, leaving: leav-ing: an estate in real and personal property prop-erty of tho probable value of ?10,000. In tho will, which has been admitted to probate, William Aeper, Alfred Sol-, Sol-, omon and August W. Carlson were 1 named as executors. Carlson doclincd to act and letters testamentary -wero issued to Aapar and Solomon In December, De-cember, 1001. The petition sets out that tho cx-' cx-' ecutors have failed and neglected to take care of or to promote the interests inter-ests of all or any of the petitioners, in that they have nold, under orders o ' the. court, certain of the personal and real property of the estate at prices largely disproportionate to the value the property, to the damage of tho estate es-tate and heirs In the sum of 31000. It is alleged that they are now attcmpt-inc,' attcmpt-inc,' to make other sales at prices disproportionate dis-proportionate to the value of the property, prop-erty, and that at least on two different occasions the petitioners have been compelled to retain legal services in protesting against proposed sales. Sev-nral Sev-nral Instances of alleged losses to tho r state are cited.' It is contended that there is no longer any need of continuing contin-uing in offlco the executors, and the paying of expensive Attorneys' fees. The petitioners pray that the executors execu-tors be cltod to appear and show couse why they should not be removed, and that upon their removal tho Utah Savings Sav-ings and Trust company be appointed special administrator of the estate. |
