Unless the context requires otherwise, other-wise, all references in said Traffic Code to: (1) "The State Road Commission" shall mean Kaysville City and its officers, offi-cers, departments, agencies and agents (2) "Local Authorities" shall mean the City Council of Kaysville City (3) "The Department of Public Safety Safe-ty of the State of Utah" shall mean the Chief of Police of Kaysville City or his agent (4) "Magistrate" shall mean the Circuit Cir-cuit Court, Kaysville Department, or the Judge of said Court" Whenever the context so indicates or requires, the name of Kaysville City or any of its agencies or offices shall be used in place of any State agencies or offices used in the said "Utah Criminal and Traffic Code, 1990 Edition" to the extent necessary to implement the intent of adopting the Traffic Code as referred to herein. ' ' SECTION 2: PENALTIES A new Section 6-2-11 to the Revised Ordinances is adopted to read as follows: "6-2-11: Penalties Any person violating, causing, or permitting a violation of any provisions of the Traffic Code adopted herein or incorporated by reference shall be guilty guil-ty of a class B misdemeanor and shall be punished by a fine not to exceed $1,000 or by a jail sentence not to exceed ex-ceed six (6) months, or by both.' ' SECTION 3: COPIES ON FILE There are on file at the Kaysville City offices at 23 East Center Street, Kaysville, Kays-ville, Utah, three (3) copies of the "Utah Criminal and Traffic Code, 1990 Edition" and this Ordinance and such copies are available for inspection by the public during normal working hours. SECTION 4: EFFECTIVE DATE This Ordinance shall be effective immediately im-mediately following adoption and publication pub-lication of this adopting Ordinance, one time only, in the Clipper, as required by and in accordance with the provisions provi-sions of Section 10-3-710, Utah Code Annotated, 1953. WHEREAS, Kaysville City has enacted the "Revised Ordinances of Kaysville City, 1989" (Revised Ordinances); Or-dinances); and, WHEREAS, Section 6-2-1 of the revised re-vised Ordinances, as amended, adopted the "The Utah Traffic Code, 1989-1990" 1989-1990" as and for the Traffic Code of Kaysville City; and WHEREAS, the Utah Department of Public Safety has caused to be prepared and published a revised and updated Traffic Code contained in the publication publica-tion entitled "Utah Criminal and Traffic Code, 1990 Edition"; and WHEREAS, the City is desirous of adopting the Traffic Code provisions of the "Utah Criminal and Traffic Code, 1990 Edition" as and for its Traffic Code, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF KAYSVILLE CITY, UTAH as follows: SECTION 1: ADOPTION OF TRAFFIC CODE Section 6-2-1 of the Revised Ordinances Or-dinances is hereby repealed and a new Section 6-2-1 of the Revised Ordinances Or-dinances is hereby enacted to read as follows: "6-2-1 Traffic Code Adopted A. The Traffic Code provisions consisting con-sisting of Tide 41 entiUed "Motor Vehicles", found on pages 64 through 214 of the "Utah Criminal and Traffic Code, 1990 Edition" compiled, prepared and published as a code in book form by the Utah Department of Public Safety, are hereby approved and adopted as the Traffic Code for Kaysville Kays-ville City. |
