In an opinion handed down in tho Supreme court yesterday in tho case of Charles A. Klenke, Jr., vs. the Oregon Ore-gon Short Line Railroad company, appellant, ap-pellant, the judgment of the lower court Is affirmed, with costs. The action ac-tion Is one wherein the plaintiff claimed damages for 57500 for Injuries alleged to havo been received while being put off from a moving train. The lower court rendered a verdict In the plaintiff's plain-tiff's favor for ?2500. Tho opinion is written by Chief Justice Baskln and concurred in by his associates. Another opjnlon, written by Justice Bartch, was handed down In the case of 31. C. Moon, appellant, vs. Salt Lako county and the Oregon Short Line Railroad Rail-road company. In this action, brought to quiet title to a piece of real estate, the Supreme court affirms the Judgment Judg-ment of the trial court as related ro the railroad company, but reverses the Judgment as between the appellant and Salt Lako county and orders that judgment judg-ment be entered in favor of tho plaintiff. plain-tiff. The action was brought to recover J955 alleged to be duo as insurance in-surance for the death of Frank Freeman, Free-man, "who was killed whllo in the employ em-ploy of the defendant, on February 9, 1904. Edward J. Mullen, the convict who participated In tho Jail-break at the -State prison last October, and who heretofore pleaded guilty to escaping from the penitentiary, was yesterday sentenced to an additional term of three and one-half years by Judgo Morse. The court overruled the demurrer of the defendant and then listened to an earnest plea for lenity beforo pausing sentence upon the prisoner. Passing of sentence upon Mrs. Anna M.
