BLODGETT It still has not been put into final form, but Bountiful's City Council Wednesday night approved several amendments amend-ments to the controversial foothill protective ordinance. THE COUNCIL passed several months ago the original foothill ordinancet but almost immediately the ordinance was challenged by developers who claimed that the ordinance was "too stringent." strin-gent." In an attempt to work with the developers concerning construction problems along the city's east bench, the council recommended several revisions to the ordinance. THE COUNCIL then approved some of these amendments Wednesday night but wording of the ordinance or-dinance will have to be drawn up by City Attorney Layne B. Forbes and the completed ordinance or-dinance will be ready for final approval next week. The most controversial portion of the ordinance still under study is that pertaining to "flag" or "L" shaped lots within a subdivision. FLAG LOTS are those lots which are primarily located a considerable distance off the main street with the only access ac-cess to the lots being a narrow road leading from the main street. The council decided that these access roads must have a minimum width of 30 feet and the structure (home or apartment) must be located within 200 feet of the main street. ALSO, THE structures must be built on lots with a minimum of 5,000 square feet and no portion of the lot can be narrower than 50 feet. Roads leading into the lots must be of such a design and slope that it will be easy access ac-cess for emergency vehicles. All homes must also be built within 200 feet of a fire hydrant. THE ordinance also specifies that "usable land" on each flag-shaped lot must not exceed a 30 percent slope. Also included in the ordinance or-dinance were specifications controlling minimum allowable allowa-ble lot sizes, standards for maximum allowable materials that is impervious to water to be be used on a lot, and maximum cuts and fills that will be allowed. THE COUNCIL concluded that flag or L shaped lots in any subdivision or area must be held to a minimum and suggested the planning commission com-mission guideline be a maximum of one flag-shaped lot per three regular lots. In other city council action, a low bid was accepted for purchase of a new garbage packer; Gibbons and Reed Construction Company was low bidder for nine street repair and related projects; approved rebuilding of a collapsed culvert at 400 North 1300 East; and approved action ac-tion to turn over to the city's insurance company a claim of false arrest by a Bountiful resident. TESCO Company was low "bidder on the garbage packer, outbidding two other firms with an offer of $10,285. City Engineer Jack Balling told the council that nine street repair and related projects were lumped into one major project for bidding purposes. GIBBONS AND Reed was low bidder with a figure of $85,414, about $1,100 less than J&R Construction Company. Six contractors bid on the projects. The council also approved rebuilding of a culvert that collapsed at 400 North 1300 East where the street crosses Stone Creek. MR. BALLING said the repair will be costly because of the extensive damage and slope of the terrain. He estimated es-timated the cost at $20,000, equally divided between cost of the pipe and labor. The council also decided that a retention pond could be developed at this site, but would cost an additional $10,000. The council said it would seek participation from developers of the area since the pond would be used for their benefit as a retention pond for runoff water. THE FALSE arrest claim was filed by an unidentified male resident of the city who said he was cited by the Utah Highway Patrol for no registration regis-tration or inspection sticker. He said he paid his fine in Bountiful City Court three days later but about three months later was served a warrant for arrest for failing to pay the fine or appearing in court. HE IS suing the city for $824.45 for "undue embarrassment em-barrassment and inconvenience in-convenience resulting from the false arrest." |
