Show Reach Agreement On New Zoning For Industry A public hearing on proposed changes in the Cedar City zoning ordinance extending the zones for light and heavy Industrial activity was held at the public safety building build-ing Tuesday evening with considerable consider-able Interest displayed by residents of the city. After a thorough explanation ex-planation of the proposed changes, unanimous support was given the program with the exception of a proposal to create an additional light Industrial area along the .highway East of town. While the majority of the group favored some extension In this area, the group present was definitely not united on what should be done. The major Industrial areas, both for light and heavy Industry, were designated for the area In the northwest north-west portion of the city. The area along highway 91 from the coal creek bridge north of town north to the city limits near Ray's Wasatch Wa-satch Service Station, Is designated at a light Industry section, as Is a strip between First and Second North streets, from the middle of the first block West of Main street to the West city limits. Heavy Industry In-dustry would be concentrated roughly rough-ly North of Second North and West of Main street, along the railroad tracks. The only controversial Issue officially of-ficially dlscusoed at the hearing was special toning to meet the situation with regards to the Western Wood Excelsior manufacturing plant at the mouth of the canyon. This plant Is located outside of the Industrial area and because It docs not conform con-form to the toning regulations expansions ex-pansions at the plant cannot be permitted. per-mitted. Since the plant and yard Is clean and attractive and Is not objectionable ob-jectionable at all, no protest was raised against Its continued operation opera-tion In the present location. How-(Centime How-(Centime Tt Back rap) Zoning Continued From Front Pare) ever, some objection was raised to the establishment of a small Indus trial area in that vicinity since it would open the way for the estab llshment of numerous light industrial indus-trial plants that may create an objectionable ob-jectionable situation. The group in attendance, did, however, go on record rec-ord as favoring the establishment of a small industrial area in this vicinity. It was pointed out that while the excelsior plant was established after af-ter the zoning ordinance had been passed, it was established with city approval, given because of unusual conditions resulting from war time shortages. At the time the plant was established it was impossible to provide electrical power, because of materials shortage for the plant had it been located in the Northwestern North-western part of the city.. Considerable controversy arose at the meeting as the result of a petition peti-tion filed by Woodrow Janson, asking ask-ing that he be permitted to continue con-tinue to operate a machine shop and garage at Fourth East and Center street, although it does not conform wth zoning regulations. It was pointed out that his place of business was established after the zoning law had been adopted, and after he had been refused a building build-ing permit because it was in a nonconforming non-conforming zone. However, Mr. Jan-ton Jan-ton presented a petition signed by 352 responsible citizens, and a large delegation was present to ask that the new industrial area be extended to include the Janson Machine shop and make Its operation In Its present pres-ent zone legal. Objections were raised against this, not because of any particular objection to the business as it now stands, but rather as an objection to creating new Industrial areas to meet the needs of one individual, while other Individuals in similar areas are to be excluded, particularly particular-ly when the plant had been established estab-lished In direct violation of the zoning zon-ing law that was in effect when the plant was established. It was argued that to grant special concessions con-cessions in this Instance would tend to make any further attempts at zoning useless. While no official action could be taken on the Question because no proposal for expansion had been' published, the majority of the group ! present voted in favor of changing , the zones in such a way as to make Janson's plant conform to the regulations. reg-ulations. In effect, to change the law to make it conform to the action ac-tion of the individual, rather than to bring the individual into conformity con-formity with the law. |
