Show West Bountiful Ponders Water Drainage By ALICE MITCHELL The agenda of Ihe West Bountiful City Council meeting meet-ing was a many faceted thing. A discussion concerning the possibility of the annexation of the Lggett property on 5th South, and out of the city limits, was carried on. At the invitation of Councilman Sam Allman, mayor pro tern, Mike Deemer, the city's attorney on the project attended and gave some of the high points of the matter. THE COUNTY Boundary ; Committee had been in favor of I he property's annexation to West Bountiful. Judge Palmer had at one time also given his approval. Then there had been ; some misunderstandings. F.ach city had been required to ; file a protest, Woods Cross against annexation of the prop-: prop-: erty to West Bountiful and 1 West Bountiful against Woods Cross. There were a series of cir-: cir-: cumstances which led to the ; dismissal of the plea and protest pro-test from West Bountiful. The papers were then signed giving the annexation request to Woods Cross. IN THE midst of the dilemma dilem-ma of the cities there was the ; problem of the annexation of the Kingston property. It had been suggested that the city of - West Bountiful should enter a : plea to have the Kingston property annexed to West Bountiful. After receiving no encouragement encour-agement from the Boundary Committee and the Judge, Mr. ; Deemer filed a plea to the State Supreme Court before Sep- : : tember. Mr. Deemer feels that West Bountiful was not treated : as it should have been. There was a process of overlooking the rights of West Bountiful. j MR. DEEMER reported - that the lawyer's costs and --z other costs had been $3,000 and they would probably be $3,000 higher if the case were tried in the Supreme Court. Councilman Allman and others of the council said it would be well to count the costs which would have to be shared by the citizens. Money is tight everywhere and it is a question to put a person quan-dry quan-dry when it comes to spending so much money for a gamble. Councilman Lynn Kenison said that he thought that the city should take the issue to the Supreme Court to make a precedent pre-cedent for future problems. He felt certain that they would be treated fairly by the supreme court. COUNCILMAN Allman still hesitated over using the money, unless things would be better for the city and for future fu-ture problems. Councilman J. Dewell reminded that any plans for drainage must include in-clude the surface and subsurface sub-surface waters. He also does not want the Eggetts to have to be in the middle of the problem any longer than necessary. Marv Ellis came before the council to tell of his encounter with the planning and zoning committee. He and the people in the Fackrell subdivision are still in favor of revoking the conditional use permit of Phillips. Phil-lips. He was told that Keith Salmon has copies of what has been going on in the planning and zoning committee but that the material is with him and he is out of town at the present time. Councilman Allman has been talking with the engineer about the problems of drainage in the city. ALTHOUGH Mayor Secrist was not present. Councilman Allman indicated that the Mayor is concerned about the material in the brief case and will be glad when Mr. Salmon returns. He has been doing some work searching about the drainage ordinances of the past before the city masterplan was completed. Councilman Bud Ingles said that it amazed him how many ordinances are passed and then not carried out. There is too much of passing of ordinances ordi-nances and resolutions and then no carrying through with the law breakers. SINCE THE people at Fackrell Fack-rell Subdivision have been so wrought up over the water which drains in their subdivision subdivi-sion from Phillips, they have been asking questions about whether or not Phillips followed fol-lowed all the ordinances of the city in their building and building build-ing on Councilman Allman indicated indi-cated that he had found good relationships with the Petroleum Pet-roleum company and he feels that people should not always approach them with negative attitudes. THE PEOPLE of Fackrell Subdivision have also wondered won-dered if the engineer had always al-ways carried out well in the jobs he was to do in the city. Mr. Ellis brought some pictures pic-tures of what the last heavy storm had done in his subdivision. subdivi-sion. They had sent waters into the subdivision again. The worst hit was the home of Ruby Graff. It it is bad with regular summer storms, it will be doubly bad in another flood crisis. IT IS absolutely necessary that culverts are cleaned out from time to time. Now that the bond issue passed there is money for the repairing of drainage systems in the county. Millcreek is one of the most difficult. COUNCILMAN Allman and the engineer have been studying study-ing problems on 5th South, since they feel that it is the project pro-ject of priority. It is felt that Millcreek should come down from Bountiful to the south side and cross the street to the bank building (as it is now). Then it should go west on the north side of 5th South to the west side of the D&RG tracks, thence north a bit and diagnoal to Millcreek at 11th W. The plan talked about above may not be the final route. The engineer and Mr. Allman may look into other methods of keeping Millcreek in its old creek bed, but plans will include in-clude the fact that no waters will drain into the Fackrell Subdivision. IT IS evident that there will have to be an open ditch to drain Millcreek and to keep it out of business or personal property. It was noted that Phillips Petroleum does not want flooding on their property. They would appreciate temporary tem-porary restraint and then complete com-plete restraint. COUNCILMAN Allman remarked re-marked that the citizens of West Bountiful are very concerned con-cerned with the Phillips property prop-erty and buildings. It can easily be seen that they are eager to get along with their projects. They would like to see all culverts cul-verts cleaned out periodically. Councilman J. Dewell said Phillips have planted lawns in some parts of their property. They also planted a row of trees on the sidewalk in the 8th West area. They don't plan to do any more landscaping because be-cause they are not so located as to plant a lot of gardens. They do attempt to keep their grounds weed free. ONE OF THE citizens present pre-sent asked why we couldn't empty water into the A-1 Canal. Can-al. He was told that the canal is not large enough to hold all of the drainage waters and it is not made for drainage from all over the area. MR. ELLIS showed the group present a chart he had made through computer indicating in-dicating that Phillips doesn't pay much tax. The city council authorized Mr. Ellis to again go to the county to get a complete chart on Phillips with regards to taxes they pay each year. The process of paying taxes for businesses is much different than that of residences. COUNCILMAN Bud Ingles emphasized the fact that he would like to learn the facts concerning Philips. When the councilmen agreed that Mr. Ellis should make pages of Phillips Tax Records, Re-cords, it was voted that the money paid to him should be as the result of a purchase order. COUNCILMAN Kenison said that the two small boweries bower-ies are all finished when Ralph or Bud finds the time to put the roofs on them. Picnic tables will be cemented down, so that they may not be moved. This decreases the vandalism in the area. Councilwoman Irene Janes explained that she had met with Dr. Scott before the 28th. LaVaun Cox is very much interested in-terested in helping in organizing organiz-ing groups to help each other in emergencies. MRS. JANES demonstrated a brochure of safety aids in case of emergencies and suggested sug-gested that some be bought for the city of West Bountiful. She is learning more and more things which will help in the time of emergencies. The First Ward Church is being prepared as a hospital in times of emergency. Mayor Secrist should be the coordinator. The police will be the protective service. Utility services will be in charge of councilman, as assigned. Mrs. Janes directs all people, to see tht the city is fully coordinated. MRS. JANES' committee members will assign people to work in their areas and to help where needed. There should be one person to lead ten people. Councilman Bud Ingles talked of the land adjacent to the city hall where the owner had three horses, but had gotten got-ten rid of one and now has the correct number according to the ordinance. However neighbors are rather offended with the odors of the horse. COUNCILMAN Sam All-man All-man said that the case should be looked into. A report was made by Mr. Ingles that Brandt Child has attended planning and zoning meeting to talk of his future subdivision. He will bring a complete map the next time he attends. The past week the committee and Mr. Child talked of concepts, but will now begin putting the plan on paper. MR. CHILD was jubilant that he had secured the land of Dr. Smith which makes his property more valuable. Mayor Secrist and Councilman Council-man Allman had talked of a spillway at the head of the Pages Lane storm drain as it enters into West Bountiful. TIME WAS spent talking of the budget and how they are coming along in keeping as much money to spend as they might b called upon to spend. They referred to the fact that they had not used all of their Weber Basin Water, since they had been using the well. Now they will stop using the well and will make repairs. Councilman Coun-cilman Allman said that the water utility fund is in great shape. |
