Show Salt Lake man arraigned on murder charge m ft John Bryan Monson, a Salt Lake I City man charged with the Sept. 9, 1984 murder of a West Valley man near Oakley, said Monday that he I will ground his defense on a claim of X diminished mental capacity. I Monson's attorney, Thomas Quin- I lan, filed notice of the intended I defense Monday in Coalville with $ Third District Court Judge Leonard e H. Russon, who arraigned Monson, I 22, on a first-degree murder charge. I According to Assistant Summit County Attorney Terry Christiansen, Judge Russon agreed to order Monson to undergo a psychological i evaluation at the Utah State Hospital when his attorney files the formal petition. After the evaluation is conducted, for a period not to exceed 30 days, the court will hold a hearing to determine Monson's mental capacity to stand trial. The setting of a trial date hinges on the outcome of that hearing. Monson is accused of killing Philip W. Kirby, 22, whose body was found May 5 buried under a rockpile on a farm operated by the Monument Stake of the Church of Jesus Christ of Latter Day Saints near the Weber River, eight miles east of Oakley.
