Show DEMURRERS FILED IN CASES OF OFFICERS I1ICIED Demurrers in behalf of Jerry F. Kel-lihcr Kel-lihcr and Orson H. Mohlman, police officers, indicted recently, were filed by Attorneys Hiram H. Henderson Hender-son and Roscoo C. Gwilllam and will be heard by District Judge Arthur E. Pratt tomorrow. Mr. Kelllher was Indicted on a charge of administering corporal punishment pun-ishment to a certain Chinaman. The demurrer says the facts stated do not constitute a public offense; furthermore, further-more, that tho indictment contains matter, which, if true, would constitute a legal justification or excuse of the offense charged. Tho same kind of demurrer was submitted sub-mitted in behalf of Mr. Mohlman. The demurrer argued before Judge Pratt In behalf of Denny A. Smyth, by Attorneys George Halverson and J. A. Howell, simply pleads that the indictment indict-ment includes two separate and distinct dis-tinct alleged offenses, which is forbidden forbid-den by law, and that it therefore must be quashed. Judge Pratt will probably decide on the demurrer lato today or some time tomorrow. |
