Show ANOTHER CONTEMPT CASE IN DISTRICT COURT more charges of disregard and vlola eions of injunctions served on water consumers from mondays standard at the same time that judge of the third district court granted the application of the attorneys tor the plaintiffs in the case of the north ogden irrigation company vs george A fuller et al for a citation for the defendants fend ants to show why they should not be adjudged in contempt of court a citation in another action for contempt was also granted the defendants being the same as in be first action for contempt both of which will be heard by judge fritchle on Wednesday the contempt proceedings in the second action are based on the alleged violation of a permanent injunction granted in the second district court sept 10 1892 in the case of william geddes et al vs the north ogden irrigation company the injunction referred to decreed that the eden irrigation district allow sufficient waiter to flow from their dam to fill a ditch nine feet wide at top eight feet wide at the bottom and two and one half feet deep the flow to be sixty feet per second the complaint on the contempt charges alleges that the action of george A fuller et al on the third day of august in entering the north fork of ogden river and reconstructing a dam which had been destroyed by an order of the court was in effect a violation 0 tha injunction granted sept 10 1892 aa in the other case nathaniel montgomery president of the north ogden irrigation company is therom nant it has abeen stated that if a case of contempt is shown there are other basea 0 alleged contempt that will be brought all against the some defendants and all based on alleged violation of injunctions granted in various cases covering a period of twelve years |
