Show Several cases tried in 5th District Court David Leroy Smith pleaded not guilty to a charge of theft by receiving, involving in-volving a charge of tools being taken from Mountain Bell Nov. 4, 1981. A trial date will be set. Earl John Clancy pleaded not guilty to a charge of theft by deception, a second degree felony. Again, a trial date will be set. Claudia Symond and Gary Rawlinson pleaded not guilty to a charge of production of a controlled substance, a third degree felony. A trial date will be set. Dean Wilson pleaded not guilty to a charge of distribution of a controlled substance for value, a third degree felony. Again, a trial date will be set. Charges agaiast Gordon L. Bradshaw and Nikki Odessa Burch Bradshaw were dismissed. PAROWAN A number of cases were brought before the Fifth District Court Monday and Tuesday during its monthly law and motion days. David Benson Abbot was sentenced for a previous guilty plea to theft by deception, a third degree felony, concerning materials taken from J. L. Clark. The judge stayed the imposition of the sentence and placed Abbot on two year's probation. One term of the probation is that he spend six months in the Iron County Jail, subject to a work out agreement. He was also ordered to make restitution. Ernest Robert Miller, who previously pleaded . guilty to attempted production of a controlled substance, a class A misdemeanor, also appeared for sentencing. Again, the imposition of the sentence was stayed, and he was placed one two year's probation. Kevin D. Rasmussen appeared for sentencing after pleading earlier to a charge of attempted possession of a controlled substance with intent to distribute The imDosition of the sentence was stayed, and he was placed on two year's probation. One term was that he spend 60 days in the Iron County Jail. However the execution of such was suspended if Rasmussen remained employed or in school. Wesley Melvin Fry appeared on an order to show cause concerning probation violation. His probation was revoked and he was ordered to serve his original sentence of 0 to 5 years in the Utah State Prison. Steven Howard Collins pleaded not guilty to a charge of distribution of a controlled substance with intent to distribute for value, a third degree felony. A trial date will be set. Newell Leavitt pleaded not guilty to burglary, a second degree felony. A trial date of May 5 has been set. Robert Kenneth Francis Lyon pleaded guilty to a reduced charge of possession of a controlled substance, a class B misdemeanor. He was sentenced to six months in the Iron County Jail; however, the sentence sen-tence will be suspended when Nevada authorities pick him up on charges pending there. |
