Show ORDINANCE 80-1 AN ORDINANCE PROVIDING PRO-VIDING FOR THE LICENSING OF ALL TV SETS WITHIN DAGGETT DAG-GETT COUNTY THE BOARD OF COUNTY COUN-TY COMMISSIONERS OF THE COUNTY OF DAGGETT, UTAH, ORDAINS OR-DAINS AS FOLLOWS: Section 1. TITLE. This Ordinance shall be known as the Daggett County TV Ordinance. Section 2. PURPOSE. The Board of Commissioners Commis-sioners hereby declares that Daggett County is an area so remote from regular transmission points of the large television televi-sion stations that television televi-sion is not available to the citizens of Daggett County Coun-ty by private sources: therefore, it is necessary to license all users or owners of television sets within Daggett County for the purpose of raising revenue to equip, operate and maintain television transmission and relay facilities within the County, Coun-ty, thereby making television televi-sion available to the citizens of Daggett County- Section 3. LICENSE FEES. From and after the effective date of this Ordinance, there is hereby levied and there shall be collected from and paid by the owners or users of TV sets within Daggett County, the following fees: (a) $8.00 per month for each television set owned or used in Daggett County; Coun-ty; provided, however, that in the case of persons owning or using more than one television set, the fee for each additional set shall be $1.00 per month. mon-th. (b) The said license fee shall be due and payable in advance, and after the effective date of the Ordinance Or-dinance each owner or user of a television set within Daggett County shall make application to the Secretary of the TV Board or the Daggett County Clerk for a license to operate the same. (c) The fee provided for in this section shall be in addition to any penalties provided for in Section 4 of this ordinance as hereinafter set forth. (d) The licensing period and rules regulating the use of TV sets within Daggett County Coun-ty may be promulgated by the TV Board as hereinafter designated. Section 4. PRESUM-TION. PRESUM-TION. Any television set or sets located within a residence or business establishment shall be presumed to be owned or used by the usual occupant occu-pant or user of said residence or business establishment. Section 5. PEN-alties. PEN-alties. Any person failing to license a TV set used or owned within Daggett County, or who shall fail to observe the rules and regulations of the TV Board, shall be deemed guilty of a misdemeanor misde-meanor and, upon conviction convic-tion thereof, shall be punished by a fine of not more than fifty dollars ($50.00), or by imprisonment imprison-ment in the County jail not exceeding one (1) day for each eight dollars ($8.00) of said fine, if the same is not paid. Section 6. EXCLUDED AREAS. Parties owning or using television sets in either Brown's Park or Birchcreek shall not be subject to the provisions of this ordinance in that said areas receive television televi-sion transmission service from sources other than that provided by Daggett County. Section 7. The Board of County Commissioners of Daggett County shall constitute con-stitute the TV Board for the administration of this ordinance and said board shall make such rules and regulations for its own guidance and for the operation and enforcement enforce-ment of this ordinance which will not be in conflict con-flict with said ordiancne or the laws of the State of Utah. Section 8. All prior Ordinances, Or-dinances, Resolutions or parts of ordinances or resolutions in conflict are herewith or hereby repealed upon the effective effec-tive date of this amended ordinance. Section 9. If any section, sec-tion, sub-section, sentence, clause phrase or portion of this ordinance or-dinance is for any reason held to be invalid or unconstitutional un-constitutional by the decision deci-sion of any court or competent com-petent jurisdiction, such decision shall not affect the validity of the remaining remain-ing portions of this ordinance. or-dinance.
