His appearance in court was postponed until Monday morning. Ruef issued a statement in which he made the remarkable declaration: "I just wanted to get a little rest. r - ' 1 v 4 I haven't been away from the city and am not going awayj," continued Ruef. "I am ;not. guilty of this awful1 charge." The accused man .then went on to say that he believes Judge Dunne is prejudiced against him, that a jury Jin that court would be "stuck," and that he wants.a hearing in the Supreme court. ... . IT WAS ANTICIPATED BT THE PROSECUTION THAT RUEF, THROUGH HIS ATTORNEYS, SHORTRIDGE, ACH, FAIRALL AND MURPHY, WOULD APPLY TODAY TO ONE OF THE HIGHER COURTS FOR A WRIT OF HABEAS CORPUS. Ruef "j Wanted a Rest." . Ruef issued a statement In which he savg: "When the case was ended In Judge 1 Hebbard's court last Monday end by the writ of error put Into the Supreme court of the United States, knowing that Judge Dunne had no further Jurisdiction of the proceedings. I thought I would take a rest for three or four days. "It never was my intention to evsde anV process of the court or to escape from the Jurisdiction of the court or leave the city. I never left the city nor will I do so. "My reason for taking the case to the Supreme court of the United" States was that I had been advised that Judge , Dunne had practically contracted to pack a Jury in the case which was to be heard . before him. - -. . "I ant willing to be tried upon this Infamous In-famous charge, of which I am not guilty, but I want a fair Judge and a fair Jury. I do -not propose, if it Is possible to avoid It, to go up -against a stuck Jury and a prejudiced Judge." The State Supreme court had not given Its decision early this morning In the application ap-plication of Buef's counsel for a writ of prohibition . restraining Judge Dunne from proceeding with the trial of their client. An Identical writ was denied by the District Court of Appeal. Eisor Arrested Ruef. Ruef was arres'ted last "night at Troca-dero, Troca-dero, a secluded suburban resort near the ocean beach. The arrest was made by William J. Biggy, elisor of Judge Dunne's court, and Detective Burns, who is aiding Assistant District Attorney Heney in the work of prosecuting alleged municipal "grafters." Ruef submitted as gracefully as possible to arrest and was brought to the city in an automobile. His custodians stopped for an hour at the office of Hcney, while Ruef was left in the automobile auto-mobile under guard. Ruef was later taken to a hotel. .It is said that his captors declined to take him to Jail on account of the intimate political and friendly relations existing between the Sheriff and the prisoner. |
