Show ANOTHER DELAY IN ' TRIAL OF FRANZ BOPP Crovernment Attorneys Outwitted by Defense of .General Consular Agent in San Francisco. SAX FRANCISCO, Dec. 8.A filibuster fili-buster by the defense successfully postponed post-poned testimony today of Louis J. .Smith, the government's chief witness iu the trial of Franz Bopp, German consul con-sul general here, and nix other defendants, defend-ants, who arc charged with violating the neutrality of the United States by conspiring to destroy munitions of war and property of the entente allies. That Smith will bo made the subject of a presidential pardon in order to insure in-sure introduction of his testimony, was declared tonight by John W. Preston, the United States district attorney. "If a pardon is needed one will be forthcoming,'' forth-coming,'' he said. It was said by attaches at-taches of his office that the pardon already was on tho way. I Smith, under the name of Lewis Smith, was an enlisted man with the Nineteenth infantry, stationed in Texas at Port Mcintosh when, in 3908, he stole from the jKist store articles which, together with his desertion and other acts subversive of "good order and a rmy discipline, ' ' according to the defense de-fense attorneys, resulted in his court-martini court-martini and sentence to two years at Leavenworth, Kan., prison. According to the attorneys for Consul Ccuernl popp. Vice Consul Baron K H. von Kcbaek, Lieutenant George vVilhelm von Briucken and the other defendants. Smith is automnfically disqualified as a witness in a federal court bv tho findings find-ings of this court-martial. The thefts, thev claim, constituted a felony. .Tudtfe William E.
