Show Defense Introduces Witness to Show Victim of Shooting Was Refugee. BODY IS EXHUMED TO ESTABLISH IDENTITY Five Thousand Dollars Reward for Man Shot by Roy Armstrong. Over the head of J. B. Brcnnan, who was shot and mortally wounded in a revolver re-volver duel with Hoy Armstrong, a negro, on the night of August 2L of last year, hung a reward of $5000. according to the story of Thomas B. Gallcgher, a witness introduced for tho defense, of Armstrong's trial. Tho negro is charged witli murder in the first degree for killing Brcnnan. Gallcgher came to Salt Lake from Blair, 2sTev., and he testified on the stand Saturday afternoon that he positively identified the body of Brenuan, which was exhumed Frida- night, as tho body of Y'eddy Daley, an escapod convict con-vict from the Missouri penitentiary. Daley was convicted of murder in 19U5 for ihe killing of a police officer, Patrolman Pa-trolman Claude Bricc, nt .Toplin, Mo., and sentenced to serve fifty years in the state prison. "While being taken from the prison to Carthage, Mo., to testify at the trial of a man named Butler, an accomplico in crime, Dale' escaped and was never apprehended, though a reward of $5000 was offered for his capture, Gallcgher testified that he know Daley for ten years in .Joplin and that he also knew him in Nevada, where ho was alleged to havo been living w-ith the' woman with whom he was living in this city at the time of his death, commonly known as Mrs. Bronnan. The testimony of Gallcgher came as a sensation and it was oflcrcd to show that Brennan had a past record as a "bad man." The defense is endeavoring endeavor-ing to show that the first shot was fired by Brennan and that Armstrong fired in self-defense. According lo tho story of Rav "Woods, about whom tho trouble is alleged to have been, Brennan struck her with a pair of brass knuckles ou the night of the shooting, leaving bruises on her buck, which bruises were later called to the attention of Matron Gifford, of the polioo station, according to tho testimony of Mrs. Gifford. Bay Woods testified thafc sho called an officer, who searched for her assailant, as-sailant, but he had disappeared. She was afraid to go home, however, and sho testified that she called up Ann-strong, Ann-strong, asking him to take her home. The woman testified that the shooting between the two men resulted when Armstrong came. Sho declared that Brcnnan fired the first shot. The defense has showed that the first shots fired were from appurentlyi a smaller gun than the last ones. Bronnan Bron-nan had the smaller gun of tho two, and in this connection, L. C. Moore testified Saturday morning as to the relative reports of various sizes of weapons and how sound is carried by the air currents. Other witnesses who testified Saturday Satur-day were Patrolman Joe Bush, John E. Wiscomb. Richard Wright, William Irvin and Mrs. Brennan was recalled by tho defonse. Several other witnesses are to be introduced in-troduced by the defense, according to Ma.-j. S. A. King, who is defending Armstrong. The case probably will go to the jury some time Monday afternoon. |
