Madscu was found guilty of selling liquor In tho justice courL and fined jy!)P.fi9, the supposed maximum. Tho cose wns appealed to tho district court, where It. wub brought out that the complaint under which this case was brought Into court was faulty and 11 was further found that tho ordinance under which tho city was operating made, the disposing of liquor unlawful without fixing fix-ing any punishment. The city attorny Is tho framor of this ordinance for the violation of which there Is no penalt5 and was also the framer of the faulty complaint In the Madsen case.
