Alleging that he has misappropriated the profits of. the company and failed to account therefor, and that ho has defrauded, de-frauded, the. company out' of a valuable lease on property at 133 East Second South street and also failed to pay over the rental received therefor, the Granite Coal and Feed company filed suit In tho district court Saturday against Alexander Alexan-der R. Curtis, the" former general manager, man-ager, secretary, and treasurer of the company, com-pany, asking for an accounting and for judgment for the amount found to be due. It Is alleged that Curtis was elected manager of the companv on March 19, 1009. and that during the time of his service in that capacity the business amounted to approximately 521,000, of which, It Is alleged $7000 was, profit. The company alleges that Curtis failed to keep proper books of tho business and has failed to turn over the profits to the company. com-pany. In the second count in the complaint. It 13 alleged that Curtis was authorized to lease the ground at 139 East Second South street and - construct a building thereon. He secured the lease and with the funds of the company und with the assistance of other employes and teams belonging to the company, erected the building. It had been learned, however, that the lease was taken in his own name and he refuses to transfer It to the company. Since the building was completed, It Is alleged that ho has collected rents amounting to 3150, which he has appropriated appro-priated to his own use. Judgment is asked for an accounting and for 7000, the amount of the profits of the business, $150 rents collected, and that he bo compelled to transfer tho leaso to tho company and also that he be restrained re-strained 'from disposing of the lease and jfrom collecting any further xents from the property. |
