On account of Insufficiency of evidence against them, Jesse McDonald and Hugh McDonald, who say they ure not relatives, rela-tives, were discharged In tho police court Tuesday from the charge of fighting. The complaining witness, who Is a special spe-cial police officer, had no evidence against the men and as no other witnesses wit-nesses appeared they were released. Tho failure of Minnie Fields and her attorney, William Newton, to appear In the police court Tuesday morning when the Fields woman was to have been tried before a Jury upon the charge of soliciting for Immoral purposes, nearly cost them 5100. The jury was present and when neither the defendant nor her attorney appeared, Judge Whltaker ordered or-dered the $100 bail forfeited. Mr. Newton New-ton came In a few minutes later and Informed In-formed the court that lie had been delayed de-layed In the district court and waived a Jury trial. The forfeiture was set aside and the case continued until Wednesday. . The case against W. J. Kerns, the Socialist Labor party speaker, who was arrested at the corner of State and Second Sec-ond South streets several nights ago for disturbing tho peace, was dismissed In police court Tuesday upon motion of Assistant As-sistant City Attorney W. S. Dalton. Kerns had made several inllammatory speeches against the police department and city officials, but upon his promise to leave the city tho case against him was dismissed. Ed Seibert was arraigned In the police court Tuesday upon tho charge of cruelty to animals and will have a hearing today. He pleaded not guilty to driving a crippled crip-pled and emaciated horse. A Chinaman known on tho records as John Doe Sing was arraigned In police court Tuesday upon tho charge of violating vio-lating the pure food ordinance of the city. He will be given a trial today. He conducts a restaurant at 47 West Second Sec-ond South street. A continuance was granted by Judge Whltaker In the police court Tuesday In the case against Roy Brown, who Is charged with stealing a gold" watch and $10 from Frank GJlmore. The complaining complain-ing witness was absent from the citv and tho case was continued until Saturday. Satur-day. Brown asserts that Gllmoro gave him the watch and money to keep for him while Gllmoro was drunk. Brown was released upon his own recognizance until Saturday. The case against B. Brooks, charged with assault with a deadly weapon upon Gust Eklund, was Hot in tho police court Tuesday for trial on September 7. Brooks and Eklund became engaged In a quarrel while at work for P. J. Moran, tho contractor, ns to which of the two could do the moat work. Brooks Is alleged al-leged to havo struck Eklund over the head with a gun and then fired a shot at him Brooks eluded the officers until un-til Monday, when he was arrested. When arraigned In police court Tuesday he pleaded not guilty. |
